  • My DMP advice please

    Long story, will try to keep it short!

    Due to my separation 3 years ago I had to go onto a DMP as all CC were in my sole name and due to having to find somewhere to live etc I hadn't got enough income to pay the min payments. Plus MBNA increased the APR from 0% to 33.9%

    I owed around £40k initially, payments were around £300 a month in total and eventually all 4 CC companies agreed to accept the payments and froze interest.

    DMP was OK for about 2.5 years until I got made redundant at the end of 2012.

    I offered the creditors F&Fs of 35% to begin with as my redundancy would allow this amount with a bit spare to live on for a few months.

    None of them accepted this amount but one of them has accepted the second offer of aruond 65%.

    Firs question:

    Their letter states they will accept this amount "as final settlement" so is this OK for me to pay, they wont sell the debt on or do anything sneaky? It's a Thomas Cook credit card, I think Barclaycard administer those am I right?

    I did ask on my letter that they mark the debt as settled in full on my CRA but that's not mentioned in their letter.

    My current situation is I have just started a new job but on a reduced salary and it's only temporary for 3 months but may turn into a permanent position.

    The second creditor hasn't yet replied to my second offer of 65%.

    Final creditor initially refused the 35% offer but in a letter dated 27th Feb said they may be willing to negotiate a partial settlement and then sent another letter dated 3rd March saying they'd sold the debt on to a recoveries company.

    Total debt now around £20k

    Any advice?

    They are all CCs

    Thomas Cook - £3,500
    Mint - £4,500
    MBNA - £9,500
    Virgin (MBNA) - £4,000

    I've not missed any payments as such still on the DMP but this months payments will be token ones due to the redundancy but if the job goes OK I will renegotiate.

    Cards were all opened quite a few years ago, it would be at least 4 years ago but not sure exactly.

    MBNA and Virgin both sold to Moorgate Loan Servicing Ltd.

    So if I write for the CCA and they don't have it I can tell them to go away?

    Won't the fact I've been paying for 3 years incriminate me?

        Great will do, I think certainly 3 of the 4 pre-date 2007 not sure about the other but will check.

        The ironic thing is I worked for a bank for 15 years and was made redundant 3 months ago, I never got any big bonuses though.

            Well done, Inspirational
            Once they realise you've wised up to your rights they're usually far more amenable to F&F's, plus you have the option of sitting tight for them to become Statute Barred if they are unenforceable.
            Have a mooch round the forum at the many success stories...

                              Yes, Self Employed, sorry, you can tell I've worked in IT for 8 years!

                              I'm going to try to get my own web-design company going, so if you or anyone you know wants a website doing please get in touch. I am offering reduced prices to start the ball rolling!

                              I've got a lot of experience of working for idiots so I am well qualified to be self-employed

                              While I wait for the webdesign to take off I am going to be doing a lot of mystery shopping to pay the bills.

                              The blog might generate a bit of revenue too, fingers crossed.
