  • URGENT Possible Court Action?

    Hi everyone,

    I've just received the following from Digital Financial Services (New owners of debts from SpeedCredit)

    Dear TM,

    Total Due: £4076

    Please be informed that your loan is still outstanding with Digital Finance Services UK for the above mentioned amount.

    We have tried to reach you on 2 different occasions continuously both by email and over the phone. We are disappointed that you have failed to respond any of our communications.
    We write to advise you that unless we receive a payment of £4076 within the next 7 days we will be left with no alternative but to issue court proceedings against you.

    In order to avoid legal proceedings, we advise you to visit our website www.digitalfinancialservices.co.uk and click on ‘PAY NOW’ section to make the payment for your loan. Alternately, you may use our bank details and pay via faster payment, CHAPS or wire transfer service. Our bank details are provided below-

    A/C: 43266351
    Sort Code: 406080

    If we are forced to issue proceedings against you then we will also be claiming interest, court fees and fixed solicitors costs on top of the sum outstanding. The cost structure is provided bellow-

    We trust the above will not be necessary and that we will receive payment of £4076 by 27th October 2014. You are strongly advised to contact us to the provided contact details for any assistance to arrange the payment.

    Is this a real threat or? I mean I'm now incredibly worried and I don't know what to do. Also sorry for not being on recently, I now have a beautiful baby boy and I've obviously been a little busy!

      What is this debt relating to?
      I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

        Hey Nids,

        Sorry I fell asleep, this is regarding a payday loan from SpeedCredit some 2 years ago. And the loan was for about 200-300 and now the debt is £4k

          Sorry, I'm not knowledgeable about payday loans but I'm sure someone will be along who is. In the meantime, try not to worry.

            Thanks Pixie! All crazy at the moment, packs of nappies, clothes and milk everywhere haha!

            It's just bloody typical though, as soon as I'm happy they decide to tell me they want to charge me £4k for a £300 debt.

            Ridiculous.

              I know what you mean TM. My daughter had a baby a couple of weeks ago.

                Just wanted to say congratulations on the baby! As for the letter: i know its easy for me to say, but try not to worry. Help will be along soon.
                When Gold isn't enough, there is SA Gold! New to the forum and find the UE route a bit scary? Take a look at my diary here and judge for yourself. I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.

                  Interesting that they don't know the court process.

                  In their letter they say they'll claim for this and that and costs. Really? Last I knew SCC was pay your own costs. As for the debt I think we need to let them know they're taking the piss and to supply evidence that you borrowed, and subsequently owed, what they are citing.

                  Id not be overly worried. Post judgment interest isn't allowed on CCA products unless it's in the terms which won't be the case here as ermm, they can't do it!!

                  They're trying to mess with you. I'll ask SnV to help. He's best at this stuff with PDL's.

                    And this is why I love this forum. I receive a bullying tactic letter, gets me worried, come here, within a few hours it's back to me being in control.

                        Ok, I know this is a fair amount of information to be asking for, but your answers are important, especially if they are considering a court claim. While I think that putting in a claim of £4k on a £300 debt would be extremely foolhardy, thats not to say it couldn't happen.

                        So I need the following info:

                        • Date loan taken out
                        • Date a payment was last made
                        • Status (i.e. did you discuss a payment arrangement or just stop paying)?
                        • Did you have to fill out an application form and do you have a copy?
                        • Were you given any pre-contact information or fact sheet so you could assess the affordability of the loan that was being offered to you?
                        • Were you given a credit agreement and if so do you have a copy?
                        • Did you at any time 'roll over' any of the loans (or did you 'reloan') and if so how many times?
                        • If you did roll over or reloan were you provided new pre-contract information and new credit agreement each time and if so do you have a copy?
                        • Did you receive any arrears notice/letter also containing information on where you can go to get advice on your debts?
                        • Have you received any sort of default or termination notice to your POSTAL address?
                        • When was the last time you sent any correspondence to them (either by email or post)?


                        Once you've given some answers to the above then I'm sure that we can help frame a suitable response...

                            Date loan taken out: No idea, it doesn't show up on my CRA

                            Date a payment was last made: a year and a half ago roughly
                            Status (i.e. did you discuss a payment arrangement or just stop paying)? Made £30 a month to NDR (Northern debt recovery) but for how long I really don't know
                            Did you have to fill out an application form and do you have a copy? Yes online and no I don't.

                            Were you given any pre-contact information or fact sheet so you could assess the affordability of the loan that was being offered to you? I presume so, but again I can't be sure.

                            Were you given a credit agreement and if so do you have a copy? My emails don't go back that far. So I can't see if I do or don't.

                            Did you at any time 'roll over' any of the loans (or did you 'reloan') and if so how many times? Didn't roll over

                            If you did roll over or reloan were you provided new pre-contract information and new credit agreement each time and if so do you have a copy? N/A

                            Did you receive any arrears notice/letter also containing information on where you can go to get advice on your debts? Again I'm really sorry, I don't know. I think I received a notice of reassignment advising me NDR now owned the debt but nothing to my postal address about DFS.

                            Have you received any sort of default or termination notice to your POSTAL address?
                            When was the last time you sent any correspondence to them (either by email or post)? I've never sent emails to them or written to them

                              The communication you had from them in post 1 - was that via email or to your postal address? Is the postal address they have for you correct?

                              And last question for now - have you received any sort of annual statement from them showing balance etc?
