    Hi Pixie,

    Was the bright yellow card just that, an open postcard, or was it in an envelope?

    Aren't they breaking all sorts of OFT guidelines, if open, so anyone can read it (especially your postie!)?

      Not sure whether to
      a) ignore
      b) send a quick letter detailing the dates of letters sent to them (including from when they had the account earlier in the year with Capquest sandwiched in between)
      c) Send a 'Threat to Commence Litigation (again! They've also had 2x 'Threat-O-Gram - letter Before Action, and Bryan Carter have also received this)
      d) send Enough is Enough template
      Yes send this > Threat by Creditor - Enough is Enough Response

        It was in an envelope.

          2 letters today, both for enforceable accounts. I've realised that I hadn't been updating these on my diary so I've now updated them.

          One is from Link Financial for my GE Money loan . It says that they are not prepared to let this balance remain outstanding indefinitely and asks me to contact them immediately to prevent the matter escalating further.

          Advice please.

            The second letter is for my M&S Money card from Resolution Legal Services (part of Gothia/Red Castle - very similar postcode.)
            This letter says that as I have failed to resolve this matter with Red Castle, they have passed the account to Resolution Legal Services. Unless the amount is settled or I agree to substantial instalments, they will have no alternative other than to consider commencement of legal proceedings against me.

            Advice please?

              I know that I've asked this before but I haven't received a reply. When I have checked my credit report it doesn't show my ccj. Should it? I was wondering if the dcas could see my ccj order, it might deter them from applying for one themselves

                    Letter today (hand-written envelope and an actual 1st class stamp, not franked) from Bryan Carter Solicitors re Tesco cc acknowledging my 'threat to commence litigation' letter but saying that Tescos have fully complied with my cca request. Goes on to say "As we have no record of a valid dispute we await hearing from you with your proposals for payment to discharge the above outstanding balance, failing which further action will commence."

                    Bryan Carters have already have 'Threat-O-Gram - letter Before Action' and 'Threat by Lender to Commence Litigation' templates. Time for Threat by Creditor - Enough is Enough Response?

                        After ignoring me for ages, Link are starting to come on heavy originally GE Money loan .

                        I received a 'Final Notice' from them today with the usual threats:
                        * We may instruct our field agent to collect this debt from you They can try but they can't get something that isn't there!
                        * We may choose to issue county court proceedings for recovery of the full balance plus interest and costs by securing a ccj. If they go for ccj and the payment is set at the same as the one I already have, it will be unlikely that they'll even be able to recover their costs before I pop my clogs!!
                        * A ccj is public information and a record will be held for 6 years during which period your ability to obtain credit will be affected. You don't say!! So all the defaults I have don't make any difference?
                        * We may enforce our ccj by instructing a bailiff to visit your property and seize goods - only if I default on the ccj!!
                        * We may choose to record a restriction against any property you have an interest in I don't have any property, though I am interested in old buildings. Fancy recording a restriction against Buckingham Palace?

                        Seriously though, I'm not sure what to do about this. I'm unemployed and so skint that I'm having to borrow money from my Dad to buy food.

                        1) Do I ignore it and let them go for a ccj. Would be rather stupid on their part if they have access to ccj records. I was serious about popping my clogs before they'd even recover the court costs.

                        2) Do I write to them explaining my situation? Just been looking at other threads and now understand I only need to do this if I get court papers.

                        3) Do I look into Financial Hardship and CFS? I'm not sure how long I'll be unemployed for but even doing the agency work I've done in the past I don't earn enough to pay off the debts - hence the reason why I'm in a financial mess to start with. So much for getting off my backside and re-training for a different career. They don't want to know if you're over 50!
