    3 letters received today:

    Moorcroft re Barclaycard (UE) - acknowledging receipt of correspondence. Account put on hold while they investigate.

    LTSB (UE) - they've received my complaint (ie copy of account in dispute letter from MHA Collections) and giving me a phone number for a Customer Relations Department which specialises in complaints like mine. I wonder if they have a special department for Niddified complaints?

    Fredricksons re Capital One (UE) - they are instructed to organise an arrangement for payment and I must contact them immediately so that an amicable agreement can be set in place and to prevent their client from taking any further action.

      Reply from LTSB 'specialist department.' Basically takes 2 pages to say that they don't agree that it's UE and, even if it was, I am still legally obliged to pay the money. Also say that, as I've used the card and repaid on multiple occasions, I've acknowledged that the agreemnt is valid and enforceable.

      I will ignore the letter.

        Letter from Arrow Global (MBNA credit card) telling me to take them to court (I think)!

        "We note you contend the copy agreement provided is unenforceable. We do not agree with your interpretation of the statute. We believe the agreement complies with the statute and we intend to pursue payment of the debt. You have remedy available to you by way of applying to the court for the appropriate declaration. In the absence of any such decalration and/or notice of application for the same, we will pusue the action previously advised, if any.

        In the absence of any further dispute, please now contact us to arrange a suitable repayment plan. Failure to do so may lead to your account being placed with an external debt collection agency. Please be aware that we may have to consider litigation in recovery of the balance owed if we are unable to agree an appropriate repayment plan"

        Is this their way of referring to Carey?

        I note the second paragraph contains that little word 'may'.

        Whatever, I'm going to ignore it and see what they come up with next.

          Received a letter with income and expenditure form from Newmans (Tesco credit card - UE) so that they can assess an affordable payment plan for me.

          Will ignore.

              This is normal from Lloyds - yep, ignore for now....

                Its standard, basically they are saying without you having a letter from the courts confirming it is irredeemably unenforceable, they will treat it as being enforceable and will pursue it based on those facts.

                            2 'Doorstep Collection Warning' letters received from Newmans (Tesco cc - UE), dated 5 days apart but both received today. Pay within 7 days of date of letter or they'll send someone round. The 7 days is already past for the first letter.

                            Will send 'Threat of doorstep visit' letter.

                                Received a letter from Barclaycard - "further to your letter requesting a copy of your executed agreement" (letter sent almost 12 months ago, account UE), they have sent me yet more terms and conditions.


                                The only difference (apart from the up-to-date T&Cs being different) is that they have included a page with my name and address at the time typed in a corner and a box with "your right to cancel" in the centre. I don't see how this could possibly make the agreement enforceable so I will ignore and see what they come back with next.

                                The last contact on this account was a 'Notice of Intended Litigation' from Moorcroft earlier this month to which I responded with the 'Threat O Gram - letter before action' template.
