    We (hubbie and myself) have £120k unsecured debt which was in personal names, though vast majority came from failed business –long story but we both had good credit ratings once (lol) and banks were happy to keep throwing money at us for far too long. When we held our hands up bank suggested IVA but we couldn’t get it and ended up with commercial DMC, hubbie started stuff in his name 2005 and I did rest of stuff in 2006. Been paying £89 per month since as very little disposable income but decided we are getting no where. Recommended your site by friends and have found it very helpful even before we start the UE route – thanks!

    There is a lot of stuff with Lloyds TSB as they used to like us! The stuff with them is mixed up so have numbered them for ease as we progress. In fact at least £4k of the Lloyds stuff is charges added on when they first stopped being our friends!

    Haven’t posted letter cancelling DMC yet as wanted to get the UE diary started, so once we have done that should get our paperwork back from them so may be able to make bit more sense of where the Lloyds stuff came from.

    24/2/12 another letter from moorcroft to my new address trying to confirm its me....
    2/8/2/12 threatogram before action template sent
    9/3/12 moorcrort acknowledge receipt and advise it is being dealt with by compliance dept and account on hold whilst they investigate
    18/3/12 recd a 3 page letter from moorcfort compliance have emailed Niddy for advice...ignore and wait for next move
    5/4/12 moorcorft write to say that lloyds have advised that CCA not required on this type of account, and I have 2 weeks to contact them before they follow this up..
    11/4/12 a 2 page letter from moorcroft explaining that this account not under the CCA act and i must offer a suitable payment plan i can afford, and saying a financial statement enclosed for me to complete - but it wasnt they just sent a copy of the previous letter?!
    31/5/12 Moorcroft have closed account and returned to Lloyds due to lack of response from me

    3/3/12 letter recd from iQor advising that they have been instructed to recover the full amount, (never heard of them but the address on statement letter also says iQor on Lloyds headed paper so thinking in house dept. Niddy says ignore for now

    24/10/12 recd a letter from 1st credit almost 12 months after last communication. They have now been assigned the debt and want us to contact them immediately. we can also send £10 to find out what information they hold on file about us...yeah right.
    1/11/12 wrote to 1st credit pointing out CCA request from 12 months ago has not been responded to...enclosed their acknowledgement of receipt of it to be helpful

    11/4/12 Mint write to say they are sorry to hear that we are not happy with how they have communicated with us and that they will investigate and come back to us by 30th May...lol

    2/6/12 letter from Mint apologising for not making their deadline to respond to us.
    9/6/12 letter from Mint saying that they are sorry they cannot uphold our complaint (refusal to send CCA as letter not signed) and that it is because we did not send the £1... this is true of one occasion but they have had the £1 sent twice more and still refused on grounds of letter not signed. They DO NOT ACCEPT that a digital signatuer is sufficient Any way they are crediting us with £80 to apologise for the length of time it took them to respond to us!
    12/6/12 Letter from new DCA Newmans who have been instructed by Mint. emailed Niddy as not sure where to go with the CCA thing now, Mint say we must go to the Financial Ombudsman

    5/10/12Capt ! write to say the debt management comp are no longer dealing and i must pay them directly so i can clear this debt. Ignoring for now
    5/10/12 2nd letter recd today this one from Frederickson saying that they are surprised i have now responded to Bryan Carter (assume they mean letter from May) and will be recommending their client instruct solicitors. Also ignoring this for now to see what comes next.


    Phew! Guess we will be sending a lot of letters!!!

    Hi Clearingthepast,

    welcome to the forum and congratulations on making your first steps with your UE journey/diary.

    As I'm sure you have already seen from other diaries on here you have come to the right place for good sound advice. We all started in a similar way as you have but over time things do get better.

          Hi! Have now cancelled the DMC and going to write to all the lenders ourselves - should i tell them our new address as they all still have old one as postal redirect on?

          Also would i use cca template first or another one as several debts were old current accounts

          Not even sure have typed question in right place - new to forums as well

          Any thoughts much appreciated!

                I have received a letter from 1st credit re request for CCA for MBNA - 10 days after we posted it, advising that the document is retained by their client MBNA and they have asked them to send it to us, and that we MUST contact them as soon as we receive it.

                Its now 21/11/11 and not had it through should I send another template letter to !st credit?

                Any suggestions appreciated!

                      The MBNA card, out of curiosity, is it an original MBNA card or one they bought / took over like the did with Abbey, A&L and some HBOS?

                      If its one they took over, chances are they havent got the agreement full stop.

                          Mine was an Abbey one and sadly they found the agreement so they do have some of them

                            A&L "takeover" was September 2002 for new accounts from that date (althought the customer, unless they read the very fine print would probably not have been aware), older accounts transferred in March 2003 when everything was made official

                            I seem to recall Abbey being 2001 for the "official" take over date.
