  • Good Grief! All over £200?

    I received this snot o gram concerning a small amount of money I may or may not owe. It begs a few questions and a good response

    • How can they check my credit file without my actually applying for credit?
    • Surely this would be in breach of the Data Protection Act?
    • Would they really apply for a CCJ and could they have this secured against the property they claim I own?

    This is fun. I could pay this, if I owed it of course . However their attitude makes me wanna play.

    RE: AGREEMENT NUMBER:
    OUTSTANDING BALANCE: £203.50
    CLODE FINANCE/V12 FINANCE

    I write with reference to the above numbered Agreement and further to our recent attempts to contact
    you by telephone which to date have proved unsuccessful.

    I note that you had previously agreed to make payments of £50.00 per calendar month in an effort to
    repay your outstanding account however, since your payment in February we have yet to receive a
    further payment from you and have not had the opportunity to discuss this matter with you.

    Therefore, due to your lack of co-operation, I made further enquiries and it would appear from your
    credit file that you are indeed the sole owner of ************** which you had led us to believe
    in our telephone conversation on the 13th January 2012, was an address of a friend which is clearly not
    the case.

    It is now imperative that you contact the undersigned upon receipt of this letter as failure to do so will
    leave me with little alternative but to issue a Notice of Default and should you fail to comply with the
    terms of the Notice, it will be our intention to take legal action against you which may result in a
    County Court Judgment being obtained and secured against your property at *************

    It is of course hoped that such action will not be required and I look forward to hearing from you
    shortly.

Easy, cos you gave them authority when you originally applied to the OC for whatever credit was granted (originally) - the CRA search carries forward to each new owner as does the authority to update and maintain searches.
    • Surely this would be in breach of the Data Protection Act? Nope, see above. You already gave unrestricted permission and this remains until such time the account is cleared and closed.
    • Would they really apply for a CCJ and could they have this secured against the property they claim I own? Yes - if they got a CCJ and then went to enforce it however for £200 I suspect if they sent court papers that you'd be daft not to settle it.

    This is fun. I could pay this, if I owed it of course . However their attitude makes me wanna play.

    Why not just pay it, it's £200
    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.         However I would settle in instalments if you want to have fun with them - start at £1 per month and see what they say.

        They'll never try and enforce for £200 if you're negotiating, that'd be like absolutely brilliant if they did as we'd rip em a new hole for you
