Help with Lowells chasing a SB Debt

  • Help with Lowells chasing a SB Debt

    Hey guys, a friend of mine is getting letters from Lowells regarding a debt he hasnt ackowledged or made a payment to, for over 8 years.

    Furthermore, his credit file appears to show the account as still being active, with a default still appearing on his file.

    He is going to confirm to me the date the default is on the credit file, but whatever that date is, its clearly wrong as its been 8 years since he made a payment so worse way, it should have been removed 2 years ago.

    I have pointed him towards the statued barred template letters to send to lowells, but i wonder if anyone can help with the letter he should send to the CRA to remove the entry completely.

    Also, whether a letter to lowells regarding the same should also be sent, and if so what should it say.

    It would be the DCA that you address the Default with, as they placed it NOT the CRA. If the DCA refuse then you complain to the ICO and then complain to the CRA's after the ICO clarify.

    Thing is, although the lender 'should' add a default entry within 6 months not many do and thus they are adding them years after the event so the default may well be valid if it was only added like 3 years ago - hard to say till we get confirmation of actual default date from the CRA report.

    But 1st port of call is the data owner so Lowells.

      It seems a bit unfair that a credit card which hasnt been paid or ackowledged for 8 years, can report a default after 5 years of no contact. But i guess this is how these people operate.

      Ill find out the dates and get back to you.

        Get the dates first please....thing is, I bet the OC defaulted and that has expired and then a new one added later (by the DCA at takeover of account) but easy to check that as the CRA's will have a record as it'll have to be have been live within the last 6 years.

        Worry about that later, for now get me the date of the default as it shows now and we'll be able to help better then
