  • Direct Line/Wescot

November 2007 I sent off a request for a copy of the signed CCA. At the time Moorcroft had the debt. Moorcroft sent me someone else's credit agreement, not my own.
I have never received my agreement on this debt from Moorcroft at all, they said they pinned my agreement to the back of the other persons, but if they did then someone else must have received it as I didn't

I contacted National Debt Line about this and they said to use it to try and get the debt written off stating I wouldn't go to the information commissioner with this, this debt was standing at around 5k back then.

I haven't heard anything else from Moorcroft since that letter I sent and I made no payments.

Roll on to December 2011 and Direct line sent me a letter stating they were sending the debt to Arrow Global Ltd - RBS.

This morning I have received a letter from Wescot stating they are collecting the debt on behalf of Arrow Global and the debt stands at around £3700.

The thing I am bothered about is the letter does not say we may take action but failure to contact us WILL result in further action being taken. I haven't had a letter from Wescot for years but they always said we may not we will.

Should I be concerned about this? Or do I keep ignoring them?

Also I still have the other persons agreement they sent me.

      Hi ABC
Am I reading it wrong...If it's the same debt, how come it was £5K in 2007 and £3700 now, if you haven't been making payments?

Sometimes when they sell a debt the new DCA may knock off a lot of the old charges, usually if they think it would cause hassles if they litigate but this is Wescot and not Lowell so I'm not quite sure what to make of that

In Nov 2007 I left this debt standing at somewhere around 5 - 6 k.

Fine then send the template as described above - keep us updated and if they happen to call just hang up do not whatever you do admit liability as it'll be SB next year

I should say that the original loan agreement was taken out sometime around 2005

Perhaps the alleged debt is just a lot of charges?

What puzzles me is that the original creditor was said to be Direct Line. Weren't they an insurance broker?

that doesn't really matter right now as you last paid in 07 so it'll be SB in 2013 meaning we have to bat this away for a year......

When did you last pay, ie what month in 2007?

They provided loans a while back - they were financed by RBS who is their parent.....

Yes they did do insurance but they also moved onto doing unsecured loans. It was the last loan I took out before almost becoming bankrupt, I fought back from bankruptcy so as not to lose the house.

I was with CCCS for the 2 years and then found unenforceability and stopped dealing with them and the one or two that were left I dealt with myself. I managed to wipe off around 30K worth of debt.

Last payment was either in October or November of 2007.

I waited to see the outcome before I paid again, which I never did.

I should be able to give you the exact date if you can hang on until tomorrow

So it was a s.77(1) request that Moroncroft cocked up and, hence, s.77(4) applies.

Having only one parent is unfortunate, even if they had been spawned by parthenogenesis. I understood, though, that the creation of Direct Line was rather different, which may explain why the results remind one of the liaison between a young man from Dundee and an arboreal ape. (link)

OK. My last payment to Direct Line was definitely in November 2007.

I paid direct to CCCS who then processed the individual payments and sent them out around the 20th of each month, so they would have received it by the 25th roughly.

I sent the CCA requests out around the 17th November. I have some memory - which is very strange for me - of posts by Niddy, quite allot of posts, on MSE at the time posting about unenforceability (MSE do not like unenforceability)

So it is definitely November 2007
