    When Capital one sells a debt and Lowell buys it should the data from Capital one still be there because there is no information at all just information recorded from when Lowell bought the debt.

    Do you mean the previous default by Cap One is missing, or the payment data associated with the account that they previously showed?

      If Capital one recorded the data on my credit file then surly this should still show on my credit file?

      The only data that shows is 2008 onwards from when Lowell's bought the debt so I thought surly Capital one data should show?

      It shows 2008 -2012 and nothing before that but on other accounts it shows 2006 data to 2012.

        Its like Capital one never placed it on my credit file or they took it off and Lowell's just put it on in 2008 because they bought the debt.

        Its statue barred now but I know it was written off for tax purposes because it says that on a statement I got from Lowell's.

        I also know the cca was unenforceable due to it missing loads of terms and conditions so I don't know what the hell is going on.

        I will ring them on Monday and find out but just curious to know what's going on?

          When companies like Lowell buy a debt, they are supposed to come to some agreement with the creditor on who is going to take over the responsibility for reporting any data/defaults etc.

          If Lowells agree to take that over then the Cap one account data would be removed and replaced by an entry/default for Lowells, or the existing record should simply have it's name changed to Lowells.

          In either case, the default date should not be altered, and the outstanding sums should be the same and then kept up to date by the buyer.

          So presumably this is what Lowells/Cap One have done?

          If the Cap one is actually removed and then replaced with a Lowells one, then I'm not sure they are obliged to carry over the account payment history. It is somewhat irrelevant though, as all meaningful (to you) data stops on the default date. Apart from any eventual final settlement.

            Why admit a SB debt over "payment" history?

            Looking for trouble? Bored? Nuts?

            Why bother with it. What's the purpose and what does it achieve, exactly?
            I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

              Very true.

              And presumably if the debt is already statute barred, then any default is likely to come off in the next 6 months anyway. Or the next year or 2 if not registered fairly.

              Either way, it's not really worth being bothered with.

              Its statute barred, and when the default drops off, so will all other details of the accounts.

                The default drops off in July and then my credit file is totally clean

                I was just curious about Capital one details that's all.

                  I lose my last default next month. Although there is a big other nasty that will stay until later on this year.
