  • Account in Dispute letter to DCA

    Hello!
    Just a quick question, if I've sent off a letter of dispute to a DCA and they have replied that they have placed the account on hold but would like to know why the account is in dispute... do I tell them?
    I have written to the original creditor but not heard anything back from them but they do have another couple of weeks to reply to me. Does the DCA have to know of the issues that I have?

    It depends! Why is the account in dispute? Are the in breach of a CCA request or something else?

      Hey,

      It's bank charges on a student account that I had that HSBC are looking into for me.. The actual amount I'm in debt by is £3000 but HSBC are looking into maybe taking the charges off. I've also challenged the default entry but obviously not pinning my hopes on getting this removed.

      The account was last paid into in 2010, so it's not statute barred.
      I'd not heard from them for ages but registered for my credit file, I didn't realise that because of this the DCA would start writing to me at my new address, which they did in November 2012.
      I wrote to HSBC asking them to look in to the charges end of January and wrote to Mackenzie Hall at the same time. And just had a response from them last week telling my the account is on hold and if I can tell them what the dispute is about...

      I'm not sure if I should as my issue is with HSBC not them?! Not after the horrible threatening letters they've been sending me...

          What the heck is 'Bueller'?

          Anyway, Muck Hall are at the absolute bottom of the DCA food chain, and are not worth wasting breath or ink on. They buy alleged debts which the others won't touch, including statute barred debts, and look to wear people down with extremely aggressive telephone bullying.

          Leave it to the bank to decide what to do about the charges, as they are the only ones with the power to do anything. An equitable assignee such as MH couldn't help even if it wanted to.

          The bank does have some incentive to try to be reasonable, in that a formal complaint escalated to the Fobbing Off Service at least costs them a £500 mediation fee. This is the case despite the obvious fact that the FOS is entirely corrupt, and is a classic example of the criminals policing themselves.

            I guess you've never seen Ferris Bueller's Day Off then? Sorry, crappy joke for anyone that's not seen it..

            Anyway, thank you! I'll just wait to hear back from HSBC. Hopefully they will reduce the amount owed. I have wrote to them that I will take it to the FOS, so maybe that'll help...

            Muck Hall have said it is on hold, and if they do continue to write demanding payment, I have seen a letter somewhere that I can send them so will do that.

              I've just stuck that into the search engine and found out what it is – a 1986 American film. I was actually young in those days!

              If you'd used a character from one of Mozart, Rossini or Verdi's operas, I'd almost certainly have been familiar with them, but I have to admit Hollywood is not my area of expertise. Apologies.

                1986?! Wow, I would have been 8 or 9? That is a long time ago. I can't remember the important things in life but a stupid quote from a film I watched when I was 12 stays in my brain!

                      Ferris Bueller was a classic and I know exactly the line you quoted! Anyone, Anyone......

                      The best line mind you is a toss up between "If you had access to a car like this, would you take it back right away?" (Ferris to the camera) or "where's your brain"; "Why did you kick me"; "where's your brain"; "why did you kick me"; "where's your brain"; "I asked you first"!!

                      Anyways...!
