  • Cabot and Formal Account Review

    My Dad has an Egg Card (enforceable) that he is paying Cabot Financial £100pcm since 2009. Account is now around 11k from 14k.

    He has not reduced his payments and paid on time etc. But they are bugging him for a "formal account review" of his payments. Which he has ignored.

    If he ignores them for too long does he risk a CCJ?

    Hi,
    Pretty standard they will always try and get more. £100 pm seems a good repayment, I have a ccj for more than that and I pay £100 they are always asking every year for more, Itell them I cant afford anymore
    and they leave me alone.

      I would get him to consider writing back thanking them for the opportunity to review his account.

      Inform them that his income has not altered and is still earning £x/month, however with the rise in things like gas/electric, council tax, fuel, food etc that his surplus income is now less than when he first came to the arrangement, therefore may have to consider reducing his payments.

      However, as a gesture of goodwill he will continue to pay £100/month if he can, unless a review of his finances demonstrates this is unsustainable.

      This is usually enough to make them scurry back under the rock they crawled from.

          Yep! £1.00 a month or Quarter would be the figure,well be nice the greedy buggers

            CCJ probably if they got not knowing the circumstances if the account has been challenged might produce a lower figure anyway?

              Update on this - and they're "happy" that my payments remain at their current level. Although they did remind me that it will take ages! errr bovvered.

              One quick question to other people paying cabot (if there are any unfortunate enough to be) they had an account login.....but the link on their homepage has gone and the email link doesn't work.

              Don't want to call them either.

                Pity its not UE. They're lucky to be getting anything at all!

                  indeedy!! - Niddy says its Enforceable and I read that we (the consumer) lost the battle at the high court and it can be risky re-visting these agreements so I'm concentrating on the other actual UE or blaggables.

                    Is your dad a homeowner (sole name)...? If not then what harm would a CCJ do...?

                        We (the consumer) lost the Egg case at High Court.

                        Slater v Egg is a High Court ruling which was in the Mold District Registry and where HHJ chambers QC ruled Egg agreements did comply with the requirements of s61(1) A CCA 1974

                          That's what I thought I'd read elsewhere on here. I've on another thread about re-con's but it to over my head to question it when I've other more straight forward accounts and this one.....should be kept off my back now I've a continued monthly payment agreed.

                            Basically, ask Paul if you need clarity. He won't touch them which says it all..... (ie very high risk of losing).
