  • Re: Can they take money from my account?

    I have a random question.

I don't know if i mentioned this before. But I have a Santander account from before that I've been tempted to use but not sure If I can. Basically it's an account linked to one of my outstanding loans. I cancelled the card so I couldn't be charged but the payday loan company still have my account number and sort code. My DMC have an arrangement of paying per month with them but I've been told that wouldn't stop them from trying to take money from the account still.

My question is, do you think its possible to use my Santander account as my normal bank account? (paying wages in, direct debits etc.)or will them having my account number and sort code still mean they can take money from my account? If I can use this account it would be fantastic - I'm DESPERATE to move away from ThinkBanking. The fee is useless and the service it's self is dire..I HATE having to use this account.

Re: Having real issues obtaining a basic bank account.

In theory they should not be able to take any money out now you have cancelled the card. I have heard stories of it happening but I know it didn't happen to me, although Santander did allow a payment to go through when I was already over my OD limit thus causing extra charges.
I have to be honest and say that looking at your level of debt and the amount you are paying into your DMP I am alarmed. How much of your monthly payment do they take as a fee?

No I mean a PDL shark has my bank details. They have my account number and sort code. I wondered if they could take money from my Santander account this way. If they can't I can finally use that account and stop using this think banking account which is charging me 15 quid a month. But I've been told they can take money using just my account number and sort code.

Ill make a thread for my debts ASAP.

You need to be very sure of what details they have.

If they have a continuous payment authority, then they can take money at any time. This would be set up usually with your debit or credit card. So be careful if they have these details. You will need to ensure that you inform your bank not to pay this type of authority.

Not sure why they would just have your bank account details and sort code unless it was for a standing order or direct debit, or a one off payment.

Vint. I think Henry is saying that he cancelled his card a while ago. Pdls do ask for account details as well. He is asking if they can still get at his account even though he has cancelled his card.

They can't withdraw using sort code and bank acct details with out a DD mandate form if I'm not mistaken

Re: Can they take money from my account?

Once you have advised Santander that the PDL no longer has your permission to withdraw money then Santander should not permit it. If they do, then Santander are obliged to refund the money and charges that might have occurred.

Re: Can they take money from my account?

Right, so theoretically as long as I instruct Santander not to grant them payment authority then I should be fine? I'm pretty sure I will have signed some kind of DD mandate authority in the small print somewhere though that authorises them to collect payment using my sort code and account number if my card doesn't make payment. The loan is with Wonga btw.

So long as the debit or credit card is not current, just tell Santander to cancel all DD's and SO's before you start using it.

Right. I think I'll do it. Anything to get away from this awful ThinkBanking account that charges me 15 quid a month!

Be careful as some of them will say you need to notify the company that you wish to cancel the DD first, but that isnt exactly true, you have every right to instruct your bank to cancel any DD, if they put up a fuss, come back to us, and one of our guru's will point you in the right direction for the legislation to shove under their noses.

You would have probably signed what is called a Continuous Payment Authority. Whilst you dont have the same protection as that of the Direct Debit guarantee - the bank must stop payment when you withdraw your permission for it to be acted on.

If the bank state you have to contact the company, advise them that you are able to cancel it with the bank and that it fall s under the Payment Services Directive 2009 and futhermore, that guidance was issued by the FSA in January this year that banks should be cancelling CPAs at the customers request.

Re: Can they take money from my account?

I'll just provide my 2p's worth here, and what I have seen advising 1,000's of people with PDL's.

All the advice been given thus far regards recurring payment authority has been correct - IN THEORY.

In theory - yes Santander should cancel and recurring payment authority as per the payment services directly, however frequently they don't.......

In theory - report your card as lost, and a recurring payment authority should not continue to the new card, but it has been known and on the cases I am aware of Santander were the bank that allowed it........

So I'm afraid that the ONLY safe foolproof way to prevent a PDL company from helping themselves to your money is to set up that parachute account the details of which are given to no-one.

@HenryJSB - I think you need to set up a diary showing all your accounts so that you can get a little more detailed help. Once we know all your creditors, accounts etc then there may be another basic bank account out there that you can apply for thats not linked to one of your creditors.

However as it stands, personally, I would not advise putting your wages into that Santander account.

Although everything is fine in theory in terms of your bank should refund you etc, it doesn't help you at the time your account is wiped out and you have no money for food or petrol to get to work
