Hello All,

Not heard from MBNA for a long time, until recently. They have been sending letters, asking for proof that I live at the address that I claimed to be at.

So I sent them a CCA request in May.

Please see attached letter of what they are asking for.
I am thinking of sending the template that I do not need to proof my address as I have been receiving their mail but cannot find it.
can someone help please.

Have you written using a new address or using mail forwarding address? Why are they asking for verification? Makes no sense if they've previously been writing to you at that address.

That letter is from Arrow Global not MBNA so has the debt been sold recently?

Sorry for the question but I can't find a reference to any assignment on your thread.

It looks as if you may have sent your CCA request to Wescot who forwarded it to Arrow.

If you've not corresponded directly with Arrow before they may be acting cautious. I still wouldn't send them any ID at this stage, especially not anything with your signature or date of birth on it.

Yes, debt been sold on I think. I cannot find my previous posts for MNBA too.

As I have not been opening my letters back in 2013, Niddy advised to resend CCA request.
I did.....it was in May 2013.

Since then I ve not heard from them until recently.
They been sending letters to my friend's address which I was using before May 2013.
I have written to them and told them about the address I am using now and also to request CCA.

The letter I received in post 706 is the reply to my CCA request.

I am hoping to find a template to Arrow's letter. Please help.

I am puzzled as to why you're asking me to verify myself, yet here you are hassling me with letters anyway so surely you're already in breach of various legislative guidelines including the FCA CONC because if you were unsure I was the debtor, why were you writing to me with account sensitive data if you were not certain it was the debtor in question?

Your request is declined, I've made a formal request as per my rights within the CCA1974 and paid the relevant fee. Until such time you comply with my request this account is unenforceable in line with s.127(3) CCA1974.

Hi All!

Received letter from Reston dated 1/7/15

I have uploaded what I received besides the CCA.
*I don't know how to put the upload in correct order. The 2nd letter is from 1/7/15. The 1st and 3rd is the copy letter they mentioned that was sent on 29/6/2011.
Niddy have confirmed this is enforceable
Please advise what else can I do to buy time or brag as long as possible.

Also, I said I will dig up the terms and conditions back in 7/3/15.
Have finally done it.

I received terms and conditions from Arrow 25/2/15 and Restons 5/3/15.

They are both the same besides the start of the terms.

Arrow has Prudential Banking PLC and 26.1 & 26.2

Restons has EGG Banking and "1 Subject to condition 26"

Does that make any different to my CCA?

Someone else would know better then me but if something is the "same" but "different" then whatever you have is not a true copy.

Restons have given you until 17th July before they'll do anything. Even then they've only hinted that they may be instructed to issue proceedings. However Restons do issue proceedings at the drop of a hat.

That letter does not read like a LBA but since this is a £19.5k debt which has been declared enforceable you need to tread carefully.

So far it seems you have been sent CCA documents but no DN or NOA since you've not asked them for those yet.

If your last CCA request was 8th May 2013 (is that right?) it may be time to send another.

SB is not until September/October 2016 - correct me if I'm wrong please.

Can you email Niddy and me that Restons letter and all the documents they enclosed with it. We'll get back to you midweek. If not then post a reminder on this thread on Thursday.

And I received the reply which I uploaded yesterday.#713

Yep! SB is around Oct 2016. This is why I am trying to brag as long as possible.

Niddy have seen the CCA earlier this year in February via PM.
He has advised to brag as long as possible.
