    Background

    I took the loan out in December 2007 started struggling in late 2009 went to consumer credit counseling service. Due to a break up of my marriage i stopped paying in July 2011.

    Sorry I'm not bad with computers but never use forums, do i start a new post for the mastercard ( this is a good one). Thanks to never in doubt, Steve and all who helps with this site

    July Sent to Mackenzie hall a sold in dispute letter as suggested by MrsD (thanks MrsD ).

    August Received a letter from Mackenzie hall saying that the account had bee passed back to client, the above
    letter was also enclosed.

    August Received a letter from Barclay's bank saying that they had sold the account to Lowell. There was also a
    letter from Lowell
    enclosed which just said who they are and that they purchased they debt.
    Thinking of sending a dispute letter

        Happy birthday......
        I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.             On the 27/ 5 /12 Mackenzie hall sent a letter - Notification of property visit

            No reply

            On the 20/6/12 sent A direct Debit arrangement.

            Now I do not know why it should be before April 2007 but I believe that if they do not have the correct paper work they can not do anything.
            Never in doubt looked at the first credit agreement they sent me , after my request and said it was unenforceable. I have had another one but this looks the same as the first one.

              is the second one the same as the first one?
              could you upload the second one to Niddy please so that he can have a look, in the meantime I would pop off the sold in dispute letter to hold them for the moment,

                    On the 29 /9/2010 received a statement from Barclaycard saying i owed £39.99. I phoned them to query this as i had cut up my Card about 12 months before ( tried to cancel it but there was £1 odd in credit *** i future i will always request the money and cancel card).
                    They took 2 months ( adding costs to it to tll me that it was microsoft for an X box live account, i told them i was not getting a x box live account ( checked with kids ) and i had not authorize it.

                    4/11/2010 Received a letter from barclaycard they would like to help -i phoned said i did not owe this money

                    17/ 11/2010 Mercers became involved phoning and sending letters, i used the template in response to a phone call and they stopped.

                    15/2/2011 Received a letter from colder Financial - I wrote a letter x 2 stating that i did not owe this money as i had not authorized it and had not received the services, did not know anything about it until i was billed ( this was on my computer but had problems with hard drive and have lost it ).

                    22/2/2011 Received a letter from barclaycard Thanking me for the letter about their service and they would deal with the complaint. -- No Response

                    15/3/2011 Received a letter dealing with complaint. -- No Response

                    7/4/2011 Received a letter from barclaycard Final response they stated that it was a yearly subscription and i would need to provide proof of cancellation ( this was done strait away but i did not have the E-Mail)
                    ( at this point i did offer to pay for the original £39.99 but felt the charges were unjust as i did not know what this debt was ( had not used the card since August 2009, it had been cut up)

                    28/2/2012 Received a letter barclaycard account sold to Lowell (548.49) - no response

                    28/2/2012 Received a letter from Lowell Introducing themselves (just noticed that the original account number seems to be wrong ) -- no response

                    12/3/2012 Received a letter from lowell we are here to help -- No response

                    21/3/2012 Received a letter from Lowell We want to help -- No response

                    2/4/2012 Received a letter from Lowell Payment plan -- No response

                    16/4/2012 Received a letter from Lowell We can get your account in order -- No response

                    26/4/2012 Received a letter from Lowell Sending account to Red Debt Collection Services -- Asked for CCA

                    4/5/2012 Received a letter from Lowell saying that this account from which the above amount is due relates to a bank account that i held with barclays bank. whilst this account is a regulated agreement we would refer to Section 74(b) of the consumer credit act1974 whereby any requirement to supply a copy of the agreement is exempt for current bank accounts and have requested statements which show how the balance is made up. -- No response.

                    8/5/2012 Received a letter from barclays returning my £1 postal order and saying there is no sum payable under the credit agreement and therefor there is no requirement to comply.

                    17/5/2012 Received a letter from Lowell they have ordered statements -- no response

                    25/6/2012 Received a letter from Lowell They are now entitled to receive payment of the balance( along with this letter are a bunch of statements)

                    Now im confused because the statements seem to be for a barclays additions account in joint names with my ex-wife (we separated in July last year) and they match account number with the barclays letter of the 28/2/2012.
                    This is the first correspondence with this account number on that i have received.
                    Sorry a lot of these letters only have there ref number on them, very confused it may well be that my ex-wife has had accounts and im not sure, as i trusted her with the finances and signed what she asked, i know this is not a good thing now but was working a lot and trusted her so what do i do now.

                    OK found out that this was an overdraft taken out by my EX Wife without my knowledge ( an overdraft, as i understand it is not subject to a credit agreement) and was advised by Lowell to go to the police to report her for fraud but arranged a reduced amount of £350 which i paid in full.
