    Hello,
    I was hoping someone will be able to help me with this as I have no idea what to do.
    Here's a bit of my debt background first of all - I have been struggling with debt for nearly 2 yrs since partners work stopped, I had been taking advice from MSE and other forums, Istarted with £1 token offers, then borrowed money from family and managed to clear most of my £28k debt with £12k by offering F&F settlements.
    The only one I have left is a Lloyds TSB CC, they declined my first F&F and then wouldnt reply to any of my other letters. In order to clear the rest of my debts I used the money that I had for them as some (well most) declined my first offer.
    I tried to carry on with the £1 token payments until I ran out of payment slips and then started to panic. I then read about unenforceability on your previous forum so followed the process with the templates you have provided. I sent all three letters by recorded delivery - first one was on the 13th July - but have never heard anything back until now, stating that i am in arreas and need to make the token payment!!
    Sorry for the long message but thought it would be best to explain where I am upto.
    I was going to just send a copy of the letters until I read about the recent changes and thought best to ask for advice from you guys. Hope you dont mind!

    have you sent a CCA Request? If so then wait - do not pay until they respond to that!

      Hiya,

      Yes - I sent the first one on the 13th July, then a reminder on the 28th. After still no reply I sent the letter stating that I was classing it as unenforceability on the 1st Sept.

        Have they cashed the cheque / do you have proof of delivery from track-and-trace?

          I have reciepts for all 3 and they are showing on trace and trace as delivered.

          I sent Postal orders as I didnt have a cheque book, I have a reciept for the second one but not the first.

          Is that ok?

            But have you checked to see the PO has been cashed? I'm not asking a lot here, lol, i'm simply asking you to use your common sense and confirm if they have received your request? If so then forget this, it is UE until such time they do respond, current legislation (out Friday) from OFT confirms as such!

            • Sections 77-79 of the Consumer Credit Act 1974 outline the information creditors must provide to debtors under fixed-term, running account & Hire Agreements. Under these sections a debtor can pay £1 to get:
