    Hi all, very new member and hopfully I will receive some sound advice along the way, here goes,

    I owe 10 creditors a grand total of £20,000, this dates back from spending starting over ten years ago when i started my apprenticeship and spent more than i could pay back at the time on the "good will" of the companies i now owe on my good wage when i completed my apprenticeship. (hope that makes some sense)

    Until now i have never come across unenforcibility however i dont believe that i will probably be able to use that route. I have come to the conclusion that i want to be debt free within roughly two years, by this i have broken down my ins and outs and worked out that i can afford to pay £700 a month to my debts. (This i may add has only happened in the last month, until now i have never really got a frip of whats going on and had my head in the sand.)

    my biggest problem at the moment is a payday lender who wants the grand total of £1824.00 and doesnt seem to want to except my proposed offer of £67.56. I am dealing with them by email and am bouncing messages back and forth of which they just seem to refuse this amount. The interest is frozen however i have now made no payments to them for 4 months while this email tennis has been played out. I'm worried that the fact i have not paid them will not be doing me any favours in case this ever went to a court. I have told them that i will only pay them by cheque or bank transfer and they also refuse to give out banking details. They keep threatning to send my debt to a third party debt collector, of which i have urged them to carry out this threat so i can at least start paying off this debt.

    I also had issues with Quickquid. They are in very murky territory as far as I can see as their consumer credit license was issued to a UK company that is no longer trading (according to companies house).

    Now I'm sure there is a 'legit' reason where they can wriggle out of this, however I doubt very much they would like to test this in court..............

    I would keep writing to them that your offer is the maximum you can afford, the more they keep rejecting this, the more weight you also have of demonstrating an unfair relationship argument too.

    Ultimately, they cannot get blood out of a stone. You are offering to pay the debt at a rate you can afford. If, in the very unlikely event, they take you to court, this will be the rate that you will be ordered to pay.

    However they have some important bridges to cross first........

    Have Quickquid issued you with a default notice yet? I suspect the answer to this is no.

    So fail on this point!

      they have dictated to me that i can only pay them by direct debit or debit card, i understand from reading elsewhere and on here that this is because they will then empty my account of as much as possible and leave me, without a paddle, so to speak.

      Are they allowed to dictate my payment method, i have offered payment by cheque and by direct transfer. I may have told some little white lies in the sense that my account will not support DD and that i have been busted down to a cashcard only. but i need to look after my interests.

        They can dictate all they want but it does not mean you have to comply, you are the one in control now!! If they will not send you their details how about you could ask for a direct debit form - then instead of returning it use the account details from it to set up whatever payment you want to make
        You are 100% doing the right thing in not letting them have your debit card or bank account details though.

          No they cannot insist that you pay by DD or Debit Card only.

          If you have this in email from them this only strengthens an unfair relationship argument, ESPECIALLY if you have offered a payment arrangement and they have refused both the offer and something as simple as providing standing order details.

          If they refuse an offer of payment, and you have provided information that supports it is the maximum you can pay, then they dig themselves even deeper.

          I wouldn't worry for now, you are doing everything right, just stick to your guns.
