  • guarantor for loan

    Hi
My son became a guarantor for a friend who took out a £500 loan. My son though because he was unemployed they would refuse the loan but they gave his mate the loan. Now he has to pay £50 a month as his mate is not paying the loan. Any advice regarding this will be most welcome.

    Kind Regards

    Re: guarantor for loan

I fear it could be a case of learning a hard lesson. If he wasn't prepared to pay the loan himself, he should not have signed to be guarantor.

My only other thought is the words 'friend' and 'mate' are not the first ones which would have sprung to my mind about someone who'd do this to a supposed friend.

        What loan company was it?

Has your son made any payments?

They are a specialised guarantor loan provider.

Can I ask, this mate - what's he say about all this? Maybe start legal action against him and recoup it that way.

As for flm, I know one of their top dogs (they're all twats). Seems arrogance runs deep.

I wanna know more about the agreement your son ticked the box with (online) and how much he paid so far.

Is this so called mate black n blue yet?

So that his so-called 'mate' might thus grow a new head?

Just been to see sonny he has given me a document from them, In one part it says

Under this garantee and indemmnity YOU MAY HAVE TO PAY INSTEAD bla bla bla How evr, if the debtor fails to keep to his side of arreement, the creditor must send him a default notice (copy to you) giving him a chance to put things right before any claim is made on you.

Sonny has not had a default notice sent, he called them up and the girl on the line said default notice not sent littel did she know he had recorded the call. what to do now?

                  Kind Regards

well being it's almost paid up - not much you can do! Yea they've breached regs but unless you fancy suing them, best thing would be to clear your sons liability then deal with the original debtor.

                            Hiya

Sorry got distracted and now have to go sort another complaint (FOS) so will try and touch base tomorrow. Ideally if you can send me this agreement (his copy) and more details that'd be great i.e. how much is the loan for and how much is he expected to pay and how much is he paying each week/month. Things like that
