  • Barclaycard Final Response, are they right?

    Hi. I am glad to see the interent has not lost one of the best posters out there. I was sorry to see you had left MSE but it is understood why, I hope the new home is much more friendly

    I was wondering if you could give me some advice if possible.

    I sent Barclaycard the CCA, CCA reminder & the Cease letters. They never once replied and I had left it at that. However I have been finding more breathing space lately so I wanted to get it all finallised. So I complained to the FOS, funnily enough Barclaycard replied. The response to me was nonsense and purely a typed up balance and 2008 t&cs. My account was opened about 2004 so I thought rot. I replied back with Final Response template and I have attached a link to Barclaycards Final response.

    Where do i go from here? Do I request a SAR?

    Bearing in mind they have never replied with my CCA.

    Ermmm 2 questions

    1. Who suggested you go to fos

    2. Why did u go to fos?

    Absolutely pointless and you've probs caused more damage than good. You never ever ever ever chase them like a pack of dogs! You ask for cca then wait, and wait and wait even longer!

      To answer both your questions.....ME & ME I thought it was the right thing ;D

      Sorry I kind of took it upon myself that unless I got some kind of response from them I may have sent things in incorrectly. I used a postal order for the £1 so didn't know if it had been cashed.

      Lowell previously on another CCA had acknowledged everything and said no CCA we will close. I half expected the same from BC.

        Lowell is DCA so if they say they closed it only means that (i.e. THEY closed, not the original creditor, if they work on someones behalf).
        BC is another story as they are original creditor.
        From what I have gathered so far, BC do not cash out £1 fees as they can't supply CCAs so can't charge for it (because they have shredded CCAs ??? - remember a few years ago as many financial companies hired scanner specialists to work 24/7 shifts? they offered minimal rate then £5.30 p/h and saved on dedicated spaces for archives - so they saved money on rentals, paid abysmal rates for working 24/7, and now have what they deserve ;LOL - shredded CCAs and poor scans which they can't locate anyway as they obviously saved on good archiv soft which could tag scans, segregate them, etc.).
        I am not an expert (but am learning a lot from Niddy... ;;2 ) and I can say, I'd be happy to wait 6 years for their response and even would be happy if they supply me CCA after that. 6 years, I remember it, and memorise it, and repeat like mantra: 6 years.

          Hind sight is wonderful but thanks. I have been through the FOS so I might need to swallow the medicine.

          When N.I.D. gets a chance I will take the advice and not deviate from it. I have stopped all payments and will weather the storm. My mind suspects BC are blowing wind but is it the wind of truth I don't know. If suggested I will get a SAR but until then I will not correspond with them anymore.

            Ok, just sit tight and await a response from either BC or their appointed DCA and then post back again, and wait for me to come back to you - we'll get things back on track. Just sit tight, don't do anything else.

            The FOS will not and cannot judge on enforceability issues as it is for the courts to decide - not them. 2

              There is no DCA at the moment just BC, everything has been on an Arrangement to pay for about 14months no sell on. As far as I know the link I have in my first post is to the 3 pages of response they sent me, in their words it is the final response in their eyes.
