  • Barclays Credit Card and Overdraft

    Hello

I find myself in debt and would like to know where to start.

I have a Barclaycard which I owe £1500 on and also a Barclays account which i'm getting threaten about being taken to court as my balance is -£1750!

I used to use my Barclays account, with a £1200 overdraft, but going into a stupid situation regarding PDL (I know, i'm an idiot)

I had to open a new account for my wages to go in as, basically, the PDL people where just taking from my account. I'd asked them not too and this was then leaving me in more trouble as i was having no money for essential bills etc.

This is my own fault, i'm not trying to hide, i just need to know what i should do, and start.

I'm not interested in the PDL for now, I want to sort this Barclays account and Barclaycard.

I've read about asking for a CCA but is this just for the Barclaycard, or my account too?
If i am requesting these details, do i go straight to Barclays or to the 'people who've bought the debt'?

    Thanks.

    Re: Where to post this!

Overdrafts aren't covered by the usual cca regulations but you can still send a cca request. Have a look at this thread Overdrafts - CCA Information - allaboutFORUMS

As for your Barclaycard, a lot depends on when it was taken out...before April 2007 to have any chance of possibly being unenforceable.

If it was prior to April 2007 you can send a cca request to whoever is chasing you for the debt at the moment. Even if it was taken out after April 2007 you can try and blag it by sending a cca request.

You could start a UE diary Unenforceability Diaries - Read me First! - allaboutFORUMS

      Cheers

How do you mean 'blag it' though?

Do you just mean request it and hope they've made a mistake on it?

Would you say the priority is to get the Barclays Account sorted first? They can take the more drastic legal action can't they?

I wouldn't worry; Barclays probably don't know either
Good luck and get the diary going

I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.

Re: Barclays Credit Card and Overdraft

Barclays didn't keep old agreements did they. They archived to iron mountain for 3 years usually then the data wiped.

The IM blunder also wiped a lot out I'd suspect

                No question is stupid!

                Is that for your Barclaycard?

I sent my cca request to: Barclaycard PO Box 5402 Northampton NN4 1ZR

but that was a couple of years ago.

I also have this stored as a Barclaycard address:
                Barclaycard
                1234 Pavilion Drive

                Northampton, NN4 1SG

Make sure you send your cca request recorded delivery...and sign digitally!

Re: Barclays Credit Card and Overdraft

Apologies for opening a new thread, didn't realise to keep it here.

No its the overdraft one that I want to try for my current account.

I've just logged on to it, which is still possible! And I've looked at my statements, £150 in charges have been added for about 3 months too. (£150 a month not total)
Would i be entitled to reclaim those?
The account has 'payment protection' on it too, is that an avenue?

Just so confused where to being.

AH thanks for the replies, I didn't see as I was replying myself
