  • Default Help

    Hi I took out some credit cards when I was younger and struggled to pay them back. Just checked my credit report and it has

    My barclaycard as default on 24/07/2008
    and my M&S card as default on the 04/12/2007

    they have both been updated to defaulted as of last month, but I do not remember having any default letters etc to tell me this, I read somewhere that after 6 years defaults drop off your account would this mean that in 2014 and 2013 respeticvely the debt and default would drop off my account?

    Any help would be greatful as I have literally no clue when it comes to debt

    A default should drop off your account after six years, yes.

    The debt itself doesn't actually drop off but after six years of non-payment (England) will become statute barred.

    Do you know when you last made a payment?

      after the 6 years will my credit rating then improve?
      Id say it was around the same time as the default to be honest,
      are the statute barred rules the same in Wales as in England?

      Is there anyway I can try and fight it in terms of they may not have the credit agreement etc, because it cant make things worse can it by trying to see what info they really have?

        The default and ALL details of the account will be removed from your credit reports 6 years from the recorded default date.

        Statute barred rules are the same in Wales as those in England.

          Fight it in what way exactly?

          If you mean having the default removed, in most cases you will be on to a loser there.

          If you mean fight the enforceability of the debt, then yes. That is distinctly possible, but we need the info FP has requested.

            So to clarify to I have to make a new topic and then make 2 different posts one for each account? then send the cca and wait?

            It cant make things any worse can it? because ive had the usual doorstep collection threats but buried my head in the sand and nothing has come of it, just thought if i fight it they may come on stronger?

                So how would I go about improving my credit rating if they are indeed unenforceable? also once if they become statute barred will they get removed then?

                  would these letters count as written acknowledgement?
                  so with the debts being unenforceable it wont neccesarily make it easier for me to obtain credit? because now im older with a much wiser head and better job, but just not enough to pay the debt off

                  sorry about all the question just ive left it so long i have so much to ask haha

                      on my credit report it shows it was last updated 07/12 and i think this has confused me so it is 6 years for the default date which is 20/12/2007? regardless of any update?

                        You can only be defaulted once on the account, so any "update" is irrelevent to the expiry of the default. If you don't have a copy of any default notice, it might be a good idea to take a screen print for your records
