  • Possible chance of default!

Hi there I'm currently in a debt management plan with payplan I have been paying a debt with MBNA through payplan for last 5 years, currently they have not defaulted me but I received a letter saying that they had sold the debt on to "idem servicing" is it possible now that this company could in fact default me on this account has they've given it a new account number?

I'm a bit concerned because the defaults I do have will all drop off my credit report next may.

    Any advice welcomed

    Simon

They (dca or lender) can default you at any point unless you're making the contractual payments each month.

Are you quite sure they've sold it in totality (full assignment) or maybe they've outsourced the collection (partially assigned)? There's a world of difference in that the dca should do nothing unless they are fully assigned as its not their debt to default you against.

According to the letter I received MBNA have said that your outstanding balance is being sold to idem capital securities limited trading as idem servicing.

The transfer assigns all of MBNA's rights in relation to the outstanding balance under the above MBNA referenced account to idem capital securities limited.

So I'm taking it they've brought the debt? I'm a little concerned that this company may default me now! Could this be the case as I said before all over defaulted accounts will come off my credit file next year.

Would it be easier and less costly to make F&F to this company, the balance stands at £1450 ish and what should I be offering.

      Many thanks

Yours is a similar situation to mine. See my post - New DCA? - allaboutFORUMS

As Niddy says on mine, wait and see what happens.
