I am going to send an harassment letter to Freds but i would like to include the number of different numbers they use and also the Mystery person and number they keep asking for
so how does this sound?

"All of the numbers you call me from have been logged not least the 0116 where you continue to ask for a stranger and give out a reference number"

We have provided you with a copy of your defaulted terms and conditions of your original agreement and have fully complied with requirments of S78 of the cca act.

You have failed to state why you allege that the agreement is improperly executed pursuant to section 61 of the cca act 1974
the agreement was properly executed pursuant to the S61(1) OF THE CCA 1974

it contains all the precribed terms

embodies all the prescribed terms , conforms to the regs under s61(1)
Then goes on to quote Waksman in Carey v HSBC ( long paragraph)

"We do not retain the orignal signed agreement which is returned to us but scan the signature portion of the agreement and retain this with in our systems "

Yes standard letter - called 'waffle & Chocolate sauce - waffle & cr*P' - Its up to them to prove/find - Not for you to tell them 'Why' you allege the agreement UE. Heck they live in Kinder Garden world.

Received those letters from them before, if it has been deemed UE, then just take an ignore Pill and see what they'll send 'Delay the game, the closer UE ends'

They just admitted that they don't keep a copy of the CCA, only your 'Signature' (so why keep a persons signature? what do they plan to do with that)

why bother? You can mention it if you want, but there's really no need as they will not pay that much attention.... they're 'nice' like that you see

They "politely" refer me to the Key Financial information section on your credit agreement you will see specific details.

They then inform me how longi have had the card and never before have i questioned it.
also they have sent a sample copy of god knows what but it is titled Mr Sample!!!!
Then there is a blank application form ,they already sent this before with nothing more on than a tick by me in the NO box for PPI

THey also say they will continue to chase.

"in regards to your claim your agreement is unenforceable i refer you to the decision of Mr Justice Faux in McGuffick v The royal bank of scotland and HH judge Waksman in Carey v HSBC(2009) " It was clearly established in McGuffick that the following steps do not amount to enforcement"

they then list reporting or threatening to report to a CRA

passing on personal data

demanding payment

issuing a default

instruct a third party to demand payment or otherwise seek to procure payment

Threatening legal action

Over tha page there are lots of goings on and on and on about Carey
and how it was established that a recon is ok a document need not be a single copy

in a nut shell it reads more informative than a threat and also it seems to be a template or standard reply
except they go on about the signature page , which btw was a tick in the no box for ppi

should i ignore or do i needto reply xxx

received today from cap 1
they have informed Freds to act on their behalf they will be in touch shortly or i can ring them.
any response or wait till freds ring and send another "in dispute letter?"
