    a wee bundle this morning

    MBNA have sold Mr D's A&L CC to Arrow global, which is a pity for them cos we've got a lovely letter from MBNA stating they have never had a CCA and won't take Mr D to court
    so shall ignore this and see what happens

    MBNA have sold Mrs D's ex Virgin card to Arrow global as well, and guess what? Yup got a lovely letter for that one as well, no CCA available and they won't take us to court
    so shall ignore this as well

    Moorcroft boobies are sill chasing my Sainsbury's card which co-incidently I also have a nice letter for stating no full CCA available, they've had this and have chosen to ignore so I shall send a gentle reminder that its a good idea to read the letters they get sent.................

      mbna have sold my acc to them as well (AG) and I also have a letter stating no cca so they arnt going to make much money me thinks.

            There was a discussion over on bobogosing's UE diary regarding the recent 'rubbish disposal' to Arrow with Paul suggesting that it may be better to reply and not ignore them.

            The case notes he mentioned where interesting, as was the possible court room scenario of what may happen if letters are ignored.

            As you have the 'magic' letter, if it were me I would send a copy of that together with "Letter Previously Confirming No CCA" either to Arrow - or possibly to their agent if they have stated in the letter that all correspondence should be sent to a certain DCA.

              Let me just say, it is *sometimes* best to respond, not all the time and as I said, in response to Paul's comments, this is totally dependant upon the situation and past correspondence.

              So assume the creditor/dca wrote to you on a monday and you replied the same week then the following week they wrote again, three times - you would NOT respond to each letter, obviously. The fact you already responded to the first letter is enough and no matter what they send in between, you would have a damn good argument to ignore everything until such time they address your letter.

              So if they sent 30 letters then responded to you, and then tried court action I can promise you a judge would have to consider the facts and the main one being "I wrote the same week but they then bombarded me with confusing letters and nothing mentioned my letter but I have proof of postage - so I waited for a response as I cannot afford to reply to 30 letters or i'd afford to pay the debt"

              Not quite those words, but the principle behind the argument stands.

              So, yea if you have had no contact with a creditor/dca for a while and they assign it and the new owner writes then why not send a *f*ckoff* letter / acknowledgement letter? However if you're in regular communication anyway - then no, you do not need to respond to each letter received as you simply could not afford it or sustain it.

              That is a fact.

                As this is an assignment in Absolute it would seem, then both Niddy's and Paul's arguments are BOTH logical and sound. I made my feelings clear on Bobo's thread. New assignemnet then send the actual assignee, the new OWNER an "Account sold in dispute" letter. Then make the buggers work whatever the response has been and serve them with s78 request which of course they cannot ignore. Its their responsibility not yours to go pffaffing around to the OC. They won't have the docs but it is still their obligation to go get them and 12 + 2 days later they are in default of the request. So it beomes UE until they cough up the goods. I see it as almost irrelevant what has gone before once it has been sold. new owner-- new ball game, inflict as much pain on them as possible.

                    I've had both the get out of jail cards for MBNA for some time, quite a lot of time actually. Both of these have been through around 5/6 DCAs, which have all had a sufficiency of correspondence. Co-incidently the last eejits were Westcot who returned them to MBNA when they received the magic letter. So now both assigned to Arrow, who have directed us to deal with - Westcot!!! So I feel it will be OK to await this crowd of diddies attempts at collection, and when they appear, they'll get another copy of the magic letter and then they can tootle off to Arrow and moan. i agree you have to pick those to ignore and those not to ignore and I often just send a one liner reminding them it helps to read what they've been sent. I even use the big pink marker occasionally when they have been particulary dense!

                      strange one from CSL for Mr D's Lloyds
                      they are about the 3/4th DCA on this
                      sent sold in dispute
                      they sent back a strangely worded letter wanting us to confirm that we acknowledge the account (aye right)
                      sent back missing prescribed terms which it was
                      to-day a cheeky letter asking us again to confirm that he acknowledges the debt, took the money etc
                      so what now???

                      Does anyone think its time for a CPUTR(2008) or something else??

                            well that was a long peaceful period.............diary was on page 10 or something

                            the old favourites

                            MBNA - Mr D
                            MBNA - Mrs D

                            both definitely UE, both have letters from MBNA admitting UE
                            both sold to Arrow
                            both chased by Drydenfairfax solicitors in January threatening hell and damnation
                            both sent sold in dispute
                            two letters (one each) to-day saying that Drydensfairfax have been instructed to return to Arrow
                            guess another bus will be along soon.......

                            Mr D's Lloyds UE
                            been chased for some time by CSL demanding we prove to them it's UE
                            (bugger off)
                            letter from CSL to-day saying if we don't pay in 7 days (aye right) they'll return to their client with a recommendation for court.
                            Sounds like a last ditch attempt to get us to pay to me, may send them the refusal to accept UE or a one liner referring them to my last six letters, any thoughts?
