        What is the total balance?
        I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.             Letter from Hillesden (no. 10 in list today) - formerly MBNA. They've only gone and managed to drag up the CCA... only taken 7 months! I'll email it over to you for inspection. Thanks Nid.

                This is enforceable, in so much that it does contain all the necessary prescribed terms. However, that said it is still an application so worth blagging for the time being....

                Also, there was PPI, you could consider a reclaim? See here: ---> Reclaiming

                However, in the meantime, you'd probs be best blagging this and see what they try and do next, if things get too heavy then you can always back down and make a sensible offer (Settlements & Offers) and put in a PPI reclaim at the same time (to lower the balance moreso).... To blag it, respond with this: ---> CCA Query - Application Form Received

                    Just a slightly off-topic question. I have an overdraft with NatPest and because I previously had a business account with them as well, instead of shipping my account off to a DCA, they've sent it to the specialist business team... I also have a loan, which is a personal term loan but was previously a business loan that they changed.

                    Any experience of what they might do next, I'm currently not making any payments (since last August) and have made alternate banking arrangements. Ideally, I think it would be good for it to get moved on and then I can make token payments and think about doing reclaiming and getting interest stopped etc. Or should I be trying to get this done with the bank?

                      Hiya, what do you mean it was a business loan that THEY changed? Did you agree to this change, or request it (with additional funding etc) or was it a simple transfer with all the terms remaining the same? I'd not worry too much about this until they do sell it on, ignore the business recovery team though.....

                        Basically, I had closed the business account that the loan was linked to, but did have another business account with them for another business, which still runs today. Because I couldn't afford to pay them the loan repayments, they sent it to their "specialist" business team who I spoke with on the phone and they said they'd re-arrange the loan so that I could pay what I could afford. Didn't really understand anything other than the nice bit about paying what I could afford! I think I signed something, although it's possible that I didn't.

                        It's now called a personal term loan and there's about 3.5k left to pay - was paying this from current account, however this is all now over-overdrawn (currently about 2.5k) and in limbo. Presumably when the account gets sold I can put in a reclaim for the charges? Or does that need to get done before it's sold?

                          I'd sit tight for now and see what happens, if they get stroppy then just send off a CCA and lets see what they are up to..... we can still utilise SAR to get the info necessary....

                            Received a letter from Hillesden today regarding MBNA card that I sent over CCA for the other day (you said enforceable, but it's an agreement form so send copy doc letter)...

                            It says that they are happy to rely on the documentation sent and that it clearly states credit agreement at the top of the page and in the sig box etc. As it's a running account credit agreement the prescribed terms are not required to be on the face of the agreement. Blah... blah... blah...

                            Any thoughts on what to do next?

                                Received a letter from solicitors ref: HSBC 1 (no. 5 in list) which they've now proved is an overdraft. Letter is notice of intended legal action - obviously they have something to go on!!!

                                Realised that I hadn't sent out the f&f offer letter (doh!) so that's now in the post. Do you think that will do for now?
