    Hi All,

    Appreciate any assistance you can give me...

    Here's the history of my debt.

    I basically emigrated to OZ in 2005 with my then wife and young son, thinking all credit card debts etc (all of which were in my sole name) had been settled. (my ex has since told me this was not the case?!)

    However in 2008 and back in the UK (now divorced) I started receiving letters and threatening phone calls from Lowell regarding 3 separate credit card/bank account debts totalling about £6K, at this time I was unemployed and skint!

    Not knowing anything about the situation I was in, and without gaining any evidence of the above debts I started making very small payments to them on a monthly basis as I panicked and really didn't want an adverse credit history.

    My financial position at that time went from bad to worse, so in early 2009 I stopped making these payments and have since ignored all correspondance.

    I have since moved house a couple of times, but they always catch up with me.

    Then today I received the standard letter from Bryan Carter threatening court action and CCJ's in the next 10 days if payment wasn't made of £2500 (which is just one of the 3 debts I presume) etc etc.

    I'd appreciate any advice on this... the original debts must at least 8 years old so would it be possible for me to go down the unenforceability route? What would now be my best course of action?

    What are Bryan Carter threatening court action for ?

    Making that payment back in 2009 was a bad mistake.....

      They're threatening to start court proceedings if the debt to Lowell's isn't paid within the next 10 days...

      I realise the initial payments to Lowell's was a mistake... but I was being harassed by them, and at that time thought it was the best thing to do... I wasn't then aware of the 'unenforceable' route.

        Can you clarify what these debts were or do you still not know?

          Ok, so to start with send this to Lowells - see what transpires

          Then copy it and send a copy to BC and say 'see attached, which was sent to Lowells today'. That'll keep them at bay for now.

          Keep us updated here and don't chat on the phone, pay anything, do anything or say anything without speaking to us here..... you'll be fine.

                  The prove it letter will start the process rolling and allow you to control things again, send that and let's see what they respond with - DO NOT SIGN IT in your usual signature as they can copy/paste it later when we send for CCA

                      Great thanks N.I.D...

                      Just to clarify, I'm no longer in contact with Lowell's and this latest correspondence came from Bryan Carter...

                      But I send the 'prove it' letter (via royal mail) to Lowell's and also a copy of said letter (via royal mail) to Bryan Carter?

                      I am slightly concerned re: signature... as I may of signed something back when I agreed to make payments to them (Lowell's) back in 2008/2009

                      I really appreciate your guidance... sorry if I appear a bit thick

                            Yep, send the letter to Lowell and a copy to BC.....

                              Thanks for that...

                              Again to clarify, I may have been a bit vague in previous post... I'm not too concerned about them getting hold of my signature through this 'prove it' letter (as it'll be a word font (john lennon))... but they may already have it, as I may have (not too sure) signed something with them, when I agreed to start payments to them (Lowell's) back in 2008/2009.
