  • Unenforceability and moving house

    Hi

    Some advice please.

I have been going down the unenforceability route with Barclaycard since about September 2011 (it was was a Goldfish account which was transferred to Barclaycard (BC).

It has been 'batted' about a few times between debt collectors, but after I sent a copy of the letter I received from BC saying they cannot find a copy of the credit agreement and although they cannot enforce the agreement they can take any action short of enforcement, they went very quiet.

The problem is that I moved house about 18 months ago and set up a postal redirection, so that any letters from BC or others would be redirected. I can only redirect for 2 years and I am not sure whether I should contact BC to tell them this.

On the one hand, if I tell BC about the move, would I be making myself known again and perhaps flagged on their list? But, if I don't and I miss some important letters would I find myself with more problems?

I would be grateful for some help please!

    Thank you!

I'd just go and let them trace you; if they really wanted to that is.......

      Thanks Niddy

I was just a bit worried that BC may employ another debt collecter who, if they don't get a response from me regarding their 'invitation to pay' , would be able to get a CCJ against me (which so far I have avoided).

      Thanks again

Nope, they'd search and trace you first usually.... you should be fine, see what happens

          Hiya.
In exactly the same position as you mate. Last letter i received from them stated they can't find agreement and acknowledge they cannot enforce. Good enough for me. If they want to write to me, fine, but i am not telling them i've moved!

I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.

That's exactly the same worry that I have, especially in the light of BC apparently passing their Egg accounts to those crooks Marlin.

I'm in the process of trying to catch up on mail sent to my previous address (the lady who bought it isn't easy to get hold of, it seems, the neighbours say they hardly ever see her). I may also contact BC via Skype (so I can record the call) and inform them of a new address.
