  • Longest gap between Default and CCJ

    Hello
    Just wondering what the longest gap is from issuing a default notice and the Creditor choosing to obtain a CCJ. I know there isn't a time limit but do you find that the time in between is short or long (ie years later)#

    Just wondering because Ive got an account that was defaulted many many years ago but they have never pursued the CCJ route despite threats

    everyone is different

    all the DCAs behave differently

    and everyone's journey is different

    you just need to try and relax and do your best to get through and we'll help you deal with what they throw

        Well there is nothing to stop them defaulting you, screwing your credit file up for 6 years (if you care about such things) and then get a CCJ at 5 years and 11 months after the default screwing you further.

        However its not a question of when more often than not a question of if.

        I'm not saying that it won't happen, it could, but its also a small number of people that creditors choose to take to court.

        My DW was taken for a CCJ in an unseemly amount of haste by one creditor, but as I found after the event they were just about to lose a court case as it was a converted store card and hence UE.

        So in this particular instance the drive was to get as many CCJ's as possible before consumers got wise to the fact these accounts are unenforceable.

        Others? Who knows?! I'm sure there is some sort of assessment criteria applied somewhere, but if there is its surrounded by smoke and mirrors!

          They should adhere to ICO guidelines regards defaults so that you're defaulted within the first 6 months - but that doesn't mean they actually operate to the guidelines.
