I purchased a TV for my daughter before christmas. Today it wont work.
I called ASDA who put me through to the laughingly called Customer services. I was told that in order for me to get a refund i MUST provide them the reciept. Really i asked? why is that?
Their reply. "its the law"
Ohhhh Law ?? i said, well you see this is something i know a fair bit about. So please Mr ASDA tell me which section of which act you rely on for this????
I was greeted with "SILENCE" lmao then the person stuttered "its policy"
Policy? i said, yes the chap replied. So not law then ?
became very clear this guy was out of his depth at this point.
So i said what if i dont have the reciept?
His reply, well bring in a bank statement. I quickly pointed out that its christmas and its very unlikely i would have a statement with a transaction on the 24th Dec showing on it.
So he then said well if you dont have a reciept we have no obligation to do anything.
*Pause for a second** On with the Lawyers hat now***
"Ok Mr ASDA let me explain what i do for a living!!!! the Sale of Goods Act 1979 as amended protects my purchase and implies terms into our contract, see s12-15 SOGA. Now my daughters TV dont work, its faulty i am rejecting these goods i want a replacement. If you insist on this stupidity of demanding a reciept as the only proof of purchase i will sue you. "
Mr ASDA then spluttered but you must prove you brought it here.
Ahh, i said, now thats different to having a reciept, you are correct i must establish i purchased it here, but that is not the same as a reciept, i have three witnesses who will swear on oath i purchased it here. So do i need the reciept?????

It just goes to show how easily the consumer gets shafted if he isnt careful and doesnt know his rights.
