  • ASDA hahahaha if only they were right

    I purchased a TV for my daughter before christmas. Today it wont work.

    I called ASDA who put me through to the laughingly called Customer services. I was told that in order for me to get a refund i MUST provide them the reciept. Really i asked? why is that?

    Their reply. "its the law"

    Ohhhh Law ?? i said, well you see this is something i know a fair bit about. So please Mr ASDA tell me which section of which act you rely on for this????

    I was greeted with "SILENCE" lmao then the person stuttered "its policy"

    Policy? i said, yes the chap replied. So not law then ?

    became very clear this guy was out of his depth at this point.

    So i said what if i dont have the reciept?

    His reply, well bring in a bank statement. I quickly pointed out that its christmas and its very unlikely i would have a statement with a transaction on the 24th Dec showing on it.

    So he then said well if you dont have a reciept we have no obligation to do anything.

    *Pause for a second** On with the Lawyers hat now***

    "Ok Mr ASDA let me explain what i do for a living!!!! the Sale of Goods Act 1979 as amended protects my purchase and implies terms into our contract, see s12-15 SOGA. Now my daughters TV dont work, its faulty i am rejecting these goods i want a replacement. If you insist on this stupidity of demanding a reciept as the only proof of purchase i will sue you. "

    Mr ASDA then spluttered but you must prove you brought it here.

    Ahh, i said, now thats different to having a reciept, you are correct i must establish i purchased it here, but that is not the same as a reciept, i have three witnesses who will swear on oath i purchased it here. So do i need the reciept?????

    *cough cough splutter splutter* er no sir you dont

    It just goes to show how easily the consumer gets shafted if he isnt careful and doesnt know his rights.

    Law vs Policy .........Law wins every time.

      Paul,

      Well done this really does wind me up companies putting there policy before the law and in 9 out of 10 incidents the company wins purely because the consumer is not aware of there rights so takes what they are told as gospel.

      Did you get it exchanged OK in the end?

            The bit you see on most/all companies terms & conditions is:

            "This does not effect your statutory rights".

            Too f'in right it doesn't!

            Nothing a company puts in it's T&Cs or says is their policy can override those rights, which as Paul has said, include the full provisions of SOGA (and the DSR if applicable).

            Shop staff, through ignorance, lack of training, or just plain trying to take the pee, will frequently try to tell you otherwise.

            Had it happen myself more than once...

              I do not think it is through lack of training, quite the opposite in fact they are trained to tell customers of only the company policy and there training does not include that SOGA and DSR overrides any company policy.

                I meant lack of training in the correct legal rights of customers.

                Whether that is deliberate or just negligence on the company's behalf is another matter.

                However, some certainly is due to lack of training.

                I had one example where I spoke to 2 separate people, the 2nd who was not aware of my first enquiry.

                The first completely misinformed me.

                The 2nd was spot on from the very start without any prompting whatsoever.

                When I asked the 2nd why he got it right while the other hadn't, I was told

                "I was trained in it by my previous employer. That's how I know. This one doesn't give a ***! I wouldn't have known if it wasn't for my previous job."

                  It probably also goes without saying that even when staff do know the correct rights, many companies do not encourage staff to volunteer knowledge of them unless their hand is forced.

                  I think the one I got who did hated that company and was planning to leave PDQ.

                    wow, thats crazy when I took my TV back to asda I bought some DVD/TV combo for my kids room and it started doing weird things (8 months later) I didn't keep the receipt but could remember where I purchased it (ie till and rough date) and they could pull the receipt up for me!

                      Surely, sorry for being the only one to spot this so far, the obvious thing here is don't go to the vet for a swimming lesson - right?

                      Ok, Ok, Plain English - Asda = supermarket / TV = Electronics so let me ask, would you go to Comet and ask for bread and milk?

                      Maybe I am just getting too old but I find going to the right "specialist" shops is always worth the extra few pounds.

                        Yea, that's called EPOS - I have EPOS on my back-up laptop but it's only as good as the person that operates it
