    22/03 letter from Cap one they say i have had the prescribed terms that were in force at the time the account was opened along with a scanned copy of the signiture on the agreement, will scan the letter in for your comments
    after receiving their final response scanned in further in the thread have today received a letter from Carp 1
    if you do not respond to this letter to bring your arangement up to date we MAY pass to a DCA or we may Choose to sell it to a debt purchaser
    13/06 received a RED HEADED letter from Westcot" We have been instructed by our client to collect the outstanding debt" ok so Cap 1 is their client
    To avoid WESCOT taking further action we must! 1,pay ye debt in full or 2, contact them by phone, failure to do so will result in further recovery action

      Do they specify what "recovery action"?

      Wasteclot are useless. I assume you'd send an "Account sold in dispute" template, but wait for mods.

          letter from RBS dated 19th they have sent back my request and money, stating that they cannot deal with it as they require a signiture

          have today received a letter from RBS, they appologise for the delay and they REGRET TO ADVISE that the card agreement has been misfiled and they are unable to locate it
          they also accept that until they comply fully with the CCA request they are not able to enforce the agreement,
          BUT if payments stop they MAY take such actionas is legaly permitted to PURSUE the outstanding debt

          lets hope the never find it

            Rockwell are acting agents of M&S
            have received letter dated 13/06/20 saying they have complied with the request inder CCA1974 the account is not in dispute, and if I think it is I should provide full and sufficient details,
            they state' there is NO requirement under section[77][78] that the original or a photocopy of the original signed agreement be provided

                as Lloyds have insisted in all corespondance that we would have signed a CCA and they are looking for it, and will send when found i am using that statement in future
                so anyone asking why I will not pay will get a still waiting for the agreement they are looking for letter

                i asked under CPUTR if they had one or not and they wouldn't give me an answer one way or the other

                  Just remember when Credit Cards on mass were launched in late 1970s & early 1980s no agreements were sent out in respect of ACCESS just a provisal that if used once you agree to Terms & Conditions as was greatly debated in the main stream papers.

                    this was a TSB card, we are sure it started life as a debit card linked to our account, as I can remember telling a girl in one shop that I was paying by chqe and not by debit card and she was quite shirty,

                      Debit card that is interesting, is there not things going on now about debit card debt turning into credit card debt of vice versa???

                          Or the days when you went in and spoke with the old bank manager, in the days when they made the call and if they liked you, you got everything.... basically I recall 1988 and I went into my local Trustee Savings Bank (the same blue three circle thing before the 12 way buyout etc) and asked for a visa card. The manager simply said, ok I'll order it - that was that.

                          Card came and I spent

                          Agreement, well that was the bank manager telling me to repay it to which I verbally said 'of course' - never ever signed anything!

                            Ahh TSB used to be a 2-in-1 card after the expiry of the sole CGC.

                            I'll explain.

                            They had the normal cashcard and then introduced the CGC which came as a £50 solo card, i'e you could only guarantee cheques with that card, so to get cash you'd use the cashcard but to guarantee a cheque you'd use the cheque card.. Then they invented the 'BankCard 2-in-1' which became a cashcard and chequecard before finally becoming the first 3-in-1 card by using C&P at terminals.

                            Thus this would never have been a debit card prior to the 2-in-1 status. It started as a cashcard --> cc/cgc --> cc/cgc/debit

                            Credit card was called TrustCard IIRC...?
