First update in a while!!
HSBC Unsecured Loan - AIC - 2006
Balance £21803 defaulted Jan 2009
August 2011 - CCA Requested
Sept 2011 - AIC keep £1 and confirm they requesting the CCA from original lender
Oct 2011 – Random letter mentioned an apparent agreed F&F over the phone?! Ignored
Nov 2011 – Defaulted payment plan – replied with CCA Reminder - Unenforceability Threat
Dec 2011 letter from Metropolitan – a new dca!!! Letter states that Lewis DCA will be in touch in 14days…….
Red letter from lewis making final demand for balance today (letter dated 16th but received on 23rd requesting payment by 23rd!!!! sent Account Sold whilst in Dispute
Jan 2012 Letter from Howard Cohen & Co asking me to pay Lewis by 6th - letter received on 7th!!! - IGNORED
March 2012 - Lewis writes "their client has no record" of my cca request - Sent CCA Request - Final Demandwith a copy of [Sept 2011 - AIC keep £1 and confirm they requesting the CCA from original lender]
March 2012 - Letter from Lewis saying they are in touch with HSBC regarding my CCA request - on hold.
June 2012 - Got Agreement from Lewis blagging for time sentCCA Query - Missing Prescribed Terms

Letter today from Marlin Europe I limited / marlin financial services saying that HSBC sold our account to them.

Waiting for next correspondance from them..........

When you say you got agreement..what did you get Malamute?
Original signed agreement? Recon? Original and most recent T&C's?

Did you send it to Niddy for appraisal?

Hi there, from what i recall (will check this evening and confirm) - it wasn't a recon and it was an original and pretty sure i would have sent it to Niddy as I was v new to forum.

Ahhh ok.

Well since Marlin are new kids on the block, they won't know what's happened before so no harm in sending them another CCA Request if you think they're starting to get heavy.

Sent the CCA request to Marlin - will wait and see on this. Keeping an eye on CRF and no searches at the mo!

Ok - so I got a response to the CCA request I sent to Marlin:

"We confirm that we have previously requested a statement of account and copy of the agreement from the original creditor and we are still yet to receive this documentation, we will forward this to you upon recipt. Your account is on hold while we await this information"

Yay, so they acknowledge my CCA request, and account is hold - confirmed.

No news is good news- although did see that Lowell financial have searched my credit file ........ Ive dealt with them before so we will see.....

Ok - so I got a response to the CCA request I sent to Marlin:

"We confirm that we have previously requested a statement of account and copy of the agreement from the original creditor and we are still yet to receive this documentation, we will forward this to you upon recipt. Your account is on hold while we await this information"

Yay, so they acknowledge my CCA request, and account is hold - confirmed.

Fingers crossed.................................

See today that my hsbc loan has been removed from my equifax credit file - waiting to see if this means it'll reappear under a different creditor.

No news is good news- although did see that Lowell financial have searched my credit file ........ Ive dealt with them before so we will see.....

Keep us posted, Mal. I assume you have signed up for the 30 day trial, or do you pay per month to keep tabs on your credit file mate?

I'm keeping it monthly at the moment - I've a few marks due to come off and my score is improving as the default get older.

I'm not looking to get new loans/credit cards but moving in the next few years after the last of them fall away.

Will keep this updated........

My gut feeling is telling me that lowell have my loan.......

lowell searched my equifax and experian on 16th may and hsbc loan has come off my equifax report on 15th June - so maybe there is a link.....

will keep this thread up to date and the marlin one as it may show a sign for others with Marlin and outstaning CCA requests.
