    Lowells know disputes exist from letters before from Freds & some Brian carter

      quite a few of these letters popping through letterboxes, I'd wait as the others suggest until you get another letter, give them more time to lose the paperwork

        Bowells are really going for it at the moment, but it would appear they have a few disappointments heading their way courtesy of this forum.. What a shame.

          Lowells letter from Lowells just arrived now LOW101 AGAIN last one LOW101 was in July we want to help, Yeh themselves. this must be the part 2 of the 1 of 2 they quote of LOW101.

            Thanks for your replies. I will sit tight for now like everyone else. Seems like Lowells have purchased a job lot from Cap One.

              Hi All,

              Another letter received from Lowells, looks like the same as what others are receiving too. Saying they could take legal action, get my credit report, bankruptcy and that they are here to help etc.... After ignoring their 1st letter is it now time to hit them with SWID?

                I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

                If you spot any spammers, AE's, abusive or libellous posts or anything else that just doesn't feel right then please report them to me as soon as you spot them at: webmaster@all-about-debt.co.uk

                    Hi all,

                    Lowells have responded to me sending a SWID letter by saying that they have requested the agreement/statements from Cap One but could take longer than 12 days. No rush now

                      Hiya all,

                      Its taken 4 months for Restons Solicitors to get in touch. Their letter states that if i fail to agree to repayment proposals that they may be instructed to issue (without further warning) court proceedings against me. Also offering me a 30%disc if paid in full before 14 days. That ain't going to happen.

                      Just unsure as to send an LBA or the Litigation Template?? I will also include a copy of the letter that i have from MBNA stating that they could not locate the agreement.

                        Could you blank out your details and upload the letter SlickFM, or type it verbatim, so we can judge the most relevant response. In any event you will need to enclose a copy of the letter from MBNA saying they cannot provide the agreement. (Assuming they haven't come up with it since then - it's a looong thread )

                          Just to clarify, MBNA sent an incomplete document back in 2010 along with a letter stating that they cannot supply a full agreement and would not be able to issue court proceedings, no other document has been received over that time.

                          As requested please see the attached response from Restons.

                            Thanks for that.
                            Looking at the templates, I think that this one is probably most suited to your circumstances, with a slight amendment.

                            If it was me, I would replace the first 2 paragraphs with the following:

                            Thank you for your letter of xxxx re the above numbered account.
                            It feel it is most inappropriate to threaten legal action when I have made it quite clear to your client that this account is in dispute due to inability to comply with a s.78 request.
                            I enclose for your reference a copy of a letter in which the account has been deemed unenforceable by MBNA, the original owners.
                            In the second to last paragraph, replace "the original" with MBNA

                            See what others think too, if you wish

                                Hi all, not too much to report really. Had a letter from Restons who are still awaiting instructions from their client (Arrow) and 2 letters from Lowell (Cap One), still investigating my complaint and another letter saying as its passed 8 weeks i have the right to refer it to FOS.
