I went through the same process with Marlin and in the end we just agreed to disagree. Their final letter to me said "in view of your stance . . . ". I've not heard from them two years later.

However it's not for me to lull you into a false sense of security since I see Niddy has already said your account is enforceable (why was that?). I need to read back through your thread.

If Marlin want to escalate this to solicitors then you'll be told soon enough. In the meantime I don't see what else you can do other than wait for their next communication as MrsD has said.

After all this time and no payments since July 2010 this TSB loan is sadly Niddy can't find owt wrong with it at all
Probably blag it for a while till legal threats arrive, then maybe a payment plan

Niddys response back in Dec 2012 was(above). I'll wait and see what comes next as i know people get different outcomes, hoping it's a favourable one for me

That was in 2012. Who owned the debt at that point? Was it Marlin who provided the CCA which Niddy said was

Sorry I really need to familiarize myself with your thread but legal 'outcomes' (case law precedents) update all the time so you may need a get a re-check of that CCA.

I hope you don't mind me asking, is your agreement enforceable and what what was the last letter that you sent them when you reached stalemate? Just out of curiosity that's all.

I've no real idea if my CCA is/was UE because only a DJ can decide that. And as I said in my previous post the case law updates on an almost daily basis.

I do know it was in the very least 'iffy' which was enough for them to back off at the time. A county court summons could drop on my doormat any time if they decide to go after me. So far so good

The debt was still owned by LloydsTSB in Dec 12 and they provided the agreement. The account was sold to Marlin in Dec 2013, the agreement that they finally sent was checked by Niddy in Jan 15 and he confirmed that it is enforceable Thanks PlanB

Hi all,

Quick update on the above, Niddy has had another look at this and apparentley the terms are still classed as 'recons', so still technically UE at the mo
Going to send MPT's letter to Lowells this week.

Hi all,

Another letter received from Lowells (Cap One) account. No threats just asking me to get in touch to arrange a payment plan, they have sent the same letter twice in the last month. I sent them a missing mpt's letter in December but no mention of that in their last couple of letters. See what comes next.........
