      TSB Loan/Marlin update: Enforceable

      Hi all

      5 months later and a letter has arrived from Cabot financial (are they Marlin in disguise?). It say's that despite numerous attempts to contact me, i have still not agreed a repayment plan to clear this debt. If they do not hear from me they will still update my credit file and will continue to contact me to try and help. No real threats, so i have just ignored for now and will wait to see what comes next. Still 12 months till SB.

          Hi all,

          Following on from the last couple of diary entries above. Today i have received another letter from Cabot. It says as i have been unable to agree to a reasonable repayment plan, the account is being reviewed to determine whether we should commence legal action. To prevent the risk of legal action occurring you must contact us within 10 days to agree to a repayment plan.

          It's been 5 months since they replied to my mpt's letter with documents that Niddy said were enforceable. Looks like i should reply to this latest letter and was thinking of sending a threat to commence legal action letter back to Cabot and see what they reply with. Anyone agree??

            I think that may make them think about what you know that they don't, (nothing but they don't know that) so It may hold up things a little longer xx

              Marlin/Cabot TSB Loan

              Hi all,

              After replying to cabot with a formal LBA response, today i have received the following letter.

              As for Cabot saying that they have not received a CCA request. Marlin sent a letter in Feb this year saying that they have merged with Cabot and as i sent a SWID to Marlin when they bought the account back in Jan 2014 i did not send a fresh CCA to Cabot.

              Any ideas please on how to respond to their latest letter above?

                    Hi Pixie, yeah that's correct. Their letter above does not mention anything threatening. I could always risk it and see what comes next. Another option would be for me to refer them back to my mpt's letter which I sent to Marlin a good few months back although they did reply stating that the terms are present?

                      As for their name, Cabot Financial (Marlin) Ltd. I'm sure it's not quite right somehow
                      I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

                          TSB Loan Marlin/Cabot update:

                          Hi all,

                          I did as Niddy advised and sent a new CCA request to Cabot 4 weeks ago. Last week i received a letter from Cabot saying as i have not been in touch they have referred my account to Restons Solicitors. Looks like Cabot have completly ignored the CCA request and I have now received a letter from Restons in which they give me a date to get in touch by or they will issue court proceedings. As you will see they are also offering me a discount on the outstanding balance if i call them.

                          Please see their letter below. I would be grateful for any pointers on what to to do next as my understanding is that they cannot issue proceedings with a CCA request outstanding?

                            Yes the creditor can issue legal proceedings whenever they feel like it but whether they'll be able to enforce the debt in court is another matter.

                            Can you please clarify if you've had any acknowledgement or response to your recent s.77-79 CCA request to Cabot?

                            If the creditor (Cabot) or their solicitors (Restons) do issue a summons this claim will be in the Fast Track with costs consequences for both parties. Let's focus.

                            What is the "date" deadline "to get in touch" stated in the possible LBA from Restons?

                            Maybe it would be wise to email a copy of that letter to Niddy using webmaster@all-about-debt.co.uk and a copy to planb@all-about-debt.co.uk

                              Thanks for your reply. I have had no response from Cabot to the CCA request that i sent on 3rd September and the deadline Restons have given me is the 19th October. I will email a copy of the letter from Restons to both you and Niddy.

                                Good stuff.

                                Restons and Cabot may not have joined up the dots. You may need to do that for them.
