  • Capital One Reconstituted Agreement

    I'm reading these threads with great interest.

    My parents have a situation on their hands with various debts and things. My Dad suffered a heart attack after 45 odd years as a Scaffolder and they fell behind on their credit cards. As it so happens, all defaulted and they're paying them back monthly ever since with the rather meager scraps they have coming in.

    I recently told them to get CCA requests off to their creditors. Well, Capital One came back with what looks like the terms and conditions pages that everyone is talking about, complete with a signed Credit Agreement. To my (totally untrained) eye, this looks enforceable to me. However, I just thought to check. I take it the presence of a signed page as part of the reconstituted agreement is pretty much signed and sealed?

    (Great site by the way! It's nice to finally see a good crowd of knowledgeable people without the finger-wagging attitude!)

    They need more than the signed part of the agreement, they need the correct terms and conditions from the date the account was opened, they need terms and conditions that are most current, and they need the prescribed terms from the time the account was opened.

    The only way to truely know if its enforceable is to send it over to Niddy to look at.

      Agree. I've had agreements back that I thought were enforceable but Niddy said "No"

          Definitely get it checked and follow the advice from AAD. Before finding this site my knowledgeable local DJ enforced a reply slip from Cap1 with a separate leaflet of t&cs
