  • BARCLAYCARD DEFAULT

    Hi

    I have a default on my credit file from Barclaycard. The default was registered in 2010 and shows as satisfied. The actual account was opened in 2001.

    I asked Barclaycard to supply me with a valic CCA. They informed me that they are unable to locate the original CCA so cannot provide one. However, they sent me a copy of the application form.

    On two seperate occasions I have sent a SAR to Barclaycard. The first SAR was returned stating they cannot provide any information requested. And the second SAR has been completely ignored.

    Basically, can they keep reporting this information if they have no proof of an account

      you say the account was registered in 2010 were you actually in arrears with the account in 2010 when it was reported to the CRAs.?
      has the account been passed/ sold to a debt collection agency (DCA) ?
      are you paying anything on this account?

          Regardless of whether there is a CCA the fact is you did default hence the default remains for 6yrs. The proof of existence is simple, in court you are asked by a judge if you ever held the account - lie at your peril.

          Pointless paying for a SAR. Just keep that letter safe and obviously don't pay into this. Sit out the 6yr default period and move on. There was an account, don't push it or they'll likely create a recon just to shut you up and force repayment.
