  • Personal Record Retention

    Quick query.

Last month, when having the issue with PayDayUK, I filled in my details on PayDayBank website instead.

It somehow forwarded my details to QuickQuid instead.

QuickQuid are constantly harassing me now to take out a loan. I've emailed them and told them that I didn't want a loan with them and to delete and remove all my records immediately.

    They have responded with:

We regret to inform you that we are declining your request to delete your customer account records from our system for the following reasons:

    • The data was processed correctly with regards to the UK Data Protection Act of 1988 and within the terms of our Privacy Policy.
    • Record retention obligations under the UK Money Laundering regulations dictate that we store your data for five years from date of processing.

We respect your wish to keep your data private and will not release or disclose your personal information to any outside entity.
I've chanced it, and replied with:

    Thank you for your email.

However you will find that as I didn't make an application to QuickQuid, neither did I take a loan out with QuickQuid, that I am perfectly entitled to have my data removed. I am fully aware of the legal position, and will take this further if necessary.

Please ensure my records are removed forthwith.
Are they right to be able to keep my details even though I didn't apply with them, and didn't take their services???

No they are in breach of a couple of principles, ordinarily. However..... IF when you applied to Paydaybank you authorised them to share your data "with carefully selected 3rd party companies" then things change a lot!

I suspect you never realised they were a broker mate? As they aren't a lender, their existence relies on passing on your info in exchange for commission.

      Read this: http://www.paydaybank.co.uk/about.aspx

Also, check this as it shows you who is a lender & who is a broker.

      ---> http://www.whichpaydaylender.co.uk/

Now read the bottom one in the list and notice the text "broker"?

Sorry, you'll lose this fight mate. Give it up. I would.
