Hope it's ok to post the above links and info.

It's understood the changes will affect everyone who currently received Disability Living Allowance, who have good reason to why they are entitled to this benefit.

Okay, there maybe a few who are claiming this allowance where it may not be required, but there are thousands of genuine disabled people who are entitled to it, basically because of the difficulties caused by their disabilities require constant help and personal care etc, this allowance helps the disabled with things they may need, to help them get through every day life, for example, mobility to get about, and a carer is mostly required.

These changes are already causing undue distress to many, it's enough to make them feel worse than they already feel, so all I can say is god help!

I know if my son (with autism) was called for a review/assessment they can look out and may even regret doing this, my son may look as what they may say (normal) but he has his issues, and they will certainly see the worse in him, as he already suffers high anxiety disorders, and it's me that will have to pick up the pieces before and after.

Whilst there maybe some that are getting it who should not, there are also many including myself who are not getting the right rate.

DLA fraud is only 0.5% one of the lowest rates of fraud for any benefit.

Indeed the cost of tribunals, ATOS and DWP error is far greater.

I have been watching this all afternoon and the lords are putting up a good fight and thus I am still not convinced that PIP is the way forward.

Sorry they've overlooked your condition and rate PF, so wrong!!

And exactly, all that money being spent on the stated is wasted and far greater, a huge loss there already! and more waste to come by the looks of it!

I am with you PF, PIP certainly isn't the way forward!
Am still keeping an eye with interest.

My son's review/renewal is next Jan 2013, so typical if this does go to these changes!

For these reviews, they should use specialist trained docs/consultants who understands.

When we first applied for my son years ago, it was rejected, so I went to tribunal, it was like going to court and there was 3 there. 2 retired docs and another guy cannot remember what he was though, and he never once questioned me on my son's condition (autism and how it affected him), he was more interested in son's asthma!!!

I was tamping and felt humilliated!
They did award him low rate for both, but I still wasnt happy, so had it looked at within the month and managed to get more evidence from my son's specialists docs which helped, also Mencap sent them an enclosed letter.
The low rate mobility stayed the same, but the care rate went from low to high.

I went to a tribunal about my daughter's DLA many years ago and won but the stress was unreal!! My chest was so tight when I came out 'coz I'd worked myself up into a knot!!

If you're questioned about your son's asthma again, go with it because although he has autism, asthma might be the condition that swings things more easily in his/your favour. My daughter had chronic asthma as a child and the argument put forward at the tribunal was partly to do with breathing being a "bodily function"; she needed help with the "bodily function" of breathing. It was a point of law (I think) that they had trouble opposing.....

Blimey, sorry you've had to go through this ordeal as well.
It is very stressful isn't it?

Glad you finally won your case anyway, well done.

Yes I know what your saying, and my son was just one years old when he was diagnosed with asthma and still suffering now, so I guess as we had to apply all the medical conditions on the form - was the reason perhaps the guy asked the questions on that matter.

But he could also see that we did manage his asthma, even though my son does often need help with taking them and reminding as such, but then we did not feel that was relevant to why we were making a claim for the DLA for my son.
For this reason, we feel that was why they ended up awarding my son with low rates on both benefits, which I had supersessed within the month and they therefore highered this to high rate.

I was shocked though that not one question was put forward in regards of the autism and how it affected my son and also us "the family" of our full time care both day and night.
