    Especially about favouring one creditor over another, "MUST NOT DO"
    A simple but important rule I must remember while on my UE journey.

            06-02-11 Update #1

            Ref. HBOS

            Ok, 13-01-11 letter from Wescot -confirming they do not hold any more infomation and have closed their account and passed it back to HBOS.

            24-01-11 letter from Robinson Way, "Formal Demand For Payment" informing me that HBOS have appointed them to recover the outstanding amount.

            25-01-11- I responded with account in dispute template letter, and attached a copy of the letter I have from HBOS stating that they will NOT seek to enforce in court due to lack of prescribed CCA.

            02-01-11 received another letter from Robinson Way - "IMMEDIATE ACTION REQUIRED" Failure to act now may result in further action to recover the amount due "

            Not sure what to respond with - or just ignore for now ?

              RBS have sent what they say is a copy of my CCA, but it is nothing more than 5 pages of T&C, there is nothing on the "agreement" signed by me or RBS.

              27-01-11 I responded with Account in Dispute template letter
              31-01-11 letter from Triton headed "NOTICE OF LEGAL PROCEEDINGS"
              "We remain very disappointed that you have failed to settle, we have now recommended RBS that solicitors should be instruced to commence court proceedings against you.

              And goes on the say what could happen if judgment is obtained, - bailiffs, charge on my property, ect. ect.

                Update 07-02-2011

                Letter received today from Robinson Way -
                "Dear Mr Alland , In view of the contents of your letter dated 25th January 2011, we have now stopped all collection activity and closed the account, we have returned all account data to HBOS. They may choose to contact you about the account in the future.
                Note: We have informed HBOS of the reasons we have closed the collection activity on the account."

                So no longer any need to respond right now, will just await HBOS's next move.

                  Have they signed for your last letter yet? I suspect they have crossed in post/filing system so just ignore for moment.

                          Letter from Triton - Quote " [size=5]Our records confirm that RBS (Mint card) issued a full response to your request under section 78 of the CCA act. and enclosed all the relevent documention. Finally on 2nd September they issued a "final response" confirming they had met their obligation uinder the CCA act.
                          Therefore if you do not comply with payment it will leave us no alternative but to commence further action against you without further warning or delay " Unquote

                          Letter received from Green & Co Solicitors, to say they have been instructed by Triton stating -


                          "We understand that despite formal demand for payment, the above account remains unpaid, and we are likely to be instructed to commence court proceedings without further notice. You have one final oppotunity to make payment to Triton withon secen days before we proceed."

                          Going to respond with "Threat of Litigation" Template

                                Thinking of responding with - Threat-o-Gram - Letter before Action

                                NB: I notice Triton Credit Services and Greens Solicitors are trading names of RBS, so no doubt just another ploy by the bank to mislead customers by using different trading titles to confuse people with their scare tactics. (another unethical thing "Greens" do - They use window type address envolopes and fold the letter to make the word Solicitors in Bold type clearly visible in the envolope window !) obviously to upset the addressee who may be worried that other people may see the letter..I first noticed this folding the letter tactic on another letter I received from Greens a while back in relation to my UE RBS/Mint account.
