    RBS M/card

    Finally a received a response to my CCA request which was originally made in May of last year.

    RBS have sent what they say is a copy of my CCA, but to my untrained eye, it looks nothing more than 5 pages of T&C, there is nothing on the "agreement" signed by me or RBS.

    Will email page 1 over to Niddy for his advice on it.

            Been blitzed in todays post with demands, obviously the :beaker :bert :zoot must take some delight in attempting to spoil a persons weekend!
            Anyway I have updated my diary with in the posts that follow...

              Monument Visa

              Letter from Monument stating they have supplied a CCA that is fully enforceable (also enclosed a copy of their last final response in respect of my CCA UE claims dated 19th July2010)
              Strangely back in November Monument confirmed they had sold the account to CompuCredit, who via their in house DCA (Circuit Financial Solutions) wrote to me confirming CompuCredit are the new owners of the account and demanding payment of the debt.

              At the time I responded with the account sold while in dispute letter, so it looks like CompuCredit have thrown the account back at Monument?

                Lloyds TSB Visa

                Letter received stating that they repeat – That although I believe the CCA to be UE, the agreement I signed with them is fully valid and contains all prescribed T&C, and as they sent me copies of the CCA to comply with my S78 request, if I do not begin to make immediate monthly payments they will have no option but to instruct their solicitors to begin legal proceedings to enforce the agreement.

                The letter goes on to quote a recent press release by Mr Ray Watson (Director of the OFT’s Consumer Credit Group) that states [size=5]"Consumers have a right to information on debts they owe, but it is important that they realise that these sections of the act cannot write off legitimately owed debts".

                Not sure if any response is needed to this or just wait and see what their next move is?

                  Marbles visa

                  Letter from 1st Credit (not heard from these before) acting on behalf of Marbles M/card (BOS) demanding my immediate payment and states in capitol letters -
                  “DO NOT UNDERESTIMATE THE SERIOUSNESS OF THIS MATTER”

                  As I already have a letter from Marbles stating that they cannot comply with my CCA s78 request and they cannot enforce the agreement in court even though they still consider the debt to be valid. I will write back to 1st Credit and attach a copy of Marbles letter.

                    Barclaycard (formally Morgan Stanley Account)

                    Letter stating that in response to my previous correspondence (disputing the CCA) they have fully complied with my s78 request, and believe the CCA is properly executed with all prescribed terms in place, therefore reject my claim of being UE, and will continue to pursue the outstanding debt in accordance with the Barclaycard Conditions.

                    Not sure which letter to respond with, or my gut feeling is just wait and see what their next move is ?

                      Not much to report since last updates above, other than a letter yesterday from 1st Credit, on behalf of Egg.

                      Dear Mr Alland,
                      We are fully aware that many people are experiencing financial problems at this time.
                      But we have good news for you, we are in a position to offer you a substantial discount to settle this outstanding debt and write off the balance. Of course you must appreciate we can't hold this fantastic offer open for long, so PLEASE call us within 24hrs
                      .......

                      I wonder what the substantial discount will be - the £3K in interest charges Egg have loaded on the account since I ceased paying last April?

                      As the outcome of any UE fight with Egg is still very much a grey area, not sure which way to jump with this, see what offer is on the table to draw a lin under this particular fight, or hang on and see what develops
                      ??

                            You photocopy the letter from Marbles, highlight the relevant text and send it with a copy of this: ---> NEW CCA Query - Letter Previously Confirming No CCA
