    Did not hear anymore from MHA Collections, but the account was eventually passed to Wescot earlier this year, I responded with "Account sold whilst in dispute" letter.

    Have now received a response from Wescot dated 15/03/11

    Dear alland,
    We refer to your recent communication. Having contacted our client they have advised that your complaint has been resolved and we are to resume collection activity.
    In the circumstances, we believe the dispute has now been resolved and the full balance or an agreed monthly instalment is required by return.
    If in the event you believe you still have a valid dispute, please contact us with the details withon 14 days, otherwise your account will be returned to our recovery team for collection.


    Not sure what letter template to respond with.

      Letter received from ARC Europe Ltd. dated 17-03-11

      Dear alland,
      This account has now been passed to us for collection, We wish to make it quite clear that unless a substantial payment is made withon the next 10 days, along with a firm offer to clear the rest of the overdue balance, we will pass your account to solicitors, with instructions to prepare court proceedings against you.


      They were not kidding either !

      Letter received 31-03-11 from Trevor Munn Solicitors -
      Dear Sir,
      On the instructions of our client, ARC (Europe) ltd. acting on behalf of Egg Banking plc, documentation will now be prepared for the issue of a claim agianst you in the Northampton County Court, for recovery of the above debt.

      We have been instructed to prepare a county court claim in ten days from the date of this letter unless we receive payment in full or a substantial payment and a firm commitment to clear the outstanding balance.

      If it is nessessary to take this step you may be liable for court costs of £290.00.

      If the claim is issued and the debt still remains unpaid, Egg Banking plc will then seek to obtain judgment against you, which will be registered as a county court judgment.

      And goes on to say how my credit rating will be affected for 6 years, even if the judgent is fully paid ect.
      So what to do ,
      have I reached the end of the blagging line on this one, is it time to try and negotiate a reasonable repayment plan ?

        You should just ignore this letter as it is contradictory to say the least!!

          Now received a letter from Moorcroft dated 1st April.

          Dear Alland,
          I write in response to your recent communication in relation to the above account, and can confirm we have been in contact with Royal Bank of Scotland plc. Who have advised that the agreement was sent on the 23/07/10 and the final response was issued on the 02/09/10.

          Respond or await their next move ? not sure..

              I think it is time to ring Trevor Munn and tell them you've been away and just got back, and you intend on speaking to ARC.

              That will stop them taking action tomorrow - and then ring ARC and offer £50 per month (if you can afford it) and do not be bullied by them, if they push for more then refuse and say "fine. i''ll take my chances and apply for redetermination in court then"......

              Point is, how much can you afford? If they apply for a CCJ then will it affect you, ie do you have a lot of disposable income? You may need to PM me to sort a suitable repayment amount mate - also, remind me of the balance and account type with this please (ie loan/card).

                  For the benefit of privacy, and others, just to say we're chatting via PM to establish what is best, then we'll update the diary here with restricted info based on the outcome of our PM discussion.

                  Basically, we're trying to establish the best way to take this forward, in a proactive approach as opposed to caving in to the first sign of trouble......

                    Well as it looks like I have blagged the Egg account for as long as I can as it is considered enforceable.
                    In view of the letter I received with the threat of the imminent issue of a county court order, and discussions with Niddy, I bit the bullet and called Trevor Munn solicitors, who ARC credit management claim are their appointed “solicitors”, well I thought I was calling Trevor Munn, in fact as it turned out it was ARC credit management who answered the phone, ARC who are acting on behalf of Egg Banking, and Trevor Munn “are one and the same”. So, usual misleading tactics by a DCA to lead you to believe you are being contacted by an independent legal firm.


                    Anyway, to avoid the possibility of the account being passed to county court for litigation, I told the call centre representative that I was calling to let them know I would be making an offer within the next few days, after a somewhat strained conversation (which was also a little funny at times, as when he asked me for a contact phone number, I said I was calling from a friends, I said I didn’t have a phone, as I was hard of hearing, to which he responded by shouting everything down the phone at me..)



                    So as the conversation continued, he tried to get me to give him my debit card details, and he tried his best to get me to commit to an offer there and then, and he also wanted me to go through an income and expenditure survey there and then, needless to say he was unsuccessful on all counts.


                    He eventually (but reluctantly) agreed to put the account on hold which would delay any intended county court involvement for a week to give me time to make an offer in writing.


                    I was a little undecided, on whether to make a low full & final offer on the account or try for a low monthly repayment plan.


                    I have decided on making a very low F&F……which will be £8K less than the outstanding balance as it sits right now. I can’t see them being very happy with the offer, but we will see what their reaction is, if unsuccessful, I’ll go for plan B.


                    Well I will when I have thought of a plan B that is…

                          You could always add to your letter if F & F is not accepted, you'll be offering xx amount per month.

                          May work, they always try it on why shouldn't you??

                                HI Alland - as you know we are in the same position with regard to our EGGy friends, almost exactly the same infact!

                                Good luck with what you're doing, but I have decided not to fold my hand just yet. Having had one other account go the distance I am aware that if they do file for court you have a chance to make an offer when these papers are recieved, if that's what you wish to do.

                                Anyway, I'll keep you updated with my case... from what research I could find TM do bark a lot but dont often bite - that was from experiences a few years ago mind, and I am fully prepared that they are indeed going to bite this time! But I'll deal with that if and when....

                                .....of interest to me is that since my response to TM I am getting hit hard with withheld numbers - with only this account seemily active at the moment Im relating the two. If they are indeed going to court this doesn't seem like a tactic they would use - pure guess work of course. My account that did, threatened court and then did it without contacting me again.
