  • Unenforceability on a mobile phone contract?

    Hey,

    I've used UE before successfully from MSE so followed niddy over here!

    Got a letter through from red dcs on the 10th sept

    Account overdue from O2 by £130.

    I know I haven't always been very organised but I don't think I owe O2 any money....

    So... on the 20th I sent this (recorded)(delivered next day) -

    Today they replied stating that since our last letter we have not recieved payment in full or been able to set up a repayment plan etc etc...

    Do I send them a letter saying I have replied etc...

    or

    do I wait 4 more days and send a cca chaser

    or

    does un-enforcability not work in the case of a mobile? (bearing in mind i don't know what this debt is)

    Mobiles (utilities) are CCA Exempt so you cannot send them anything......

          LOL< at least you're back on track now - so send the Prove it Letter and see what they come back with.

            Well....

            Before I even sent the prove it letter...

            I got a letter from the DCS returning my pound and apologizing as I was not the person they were after.

            I guess they got the idea of what I was asking...

              Result, just check they aint added anything to your credit file.....
