  • UE or DMP route

    Hi I'm new here can anyone help please? I have 2 Q's

    I have written to 2 creditors advising of financial difficulties. I received a letter from Capital One asking me to call (I have since read here that you should NEVER do this) anyway after a long wait they said they are sending forms & wanted 3 months bank statements. 1. Do I have to send them? 2. I'm not sure though if I should go down the UE route

    Welcome to AAD! The choice of route to sort out your problems always has to be what suits you. Here we try to make sure that firstly you are or are not legally responsible to pay the debt i.e. is it UE or Not. Then should they be enforcable, then we would look at ways forward which are at the least cost to yourself. In the last resort should the very worst happen we do have preferred solicitors on the site who are specialists in this field to whom we can refer your case(s).

    This will give you a start on your road. We have template letters which are tried and tested for most situations and the owner of this site, never-in-doubt (known to everyone as Niddy) has written specials for people tailored to their specific needs. I might suggest that you have a read around particularly in the UE areas to see how others are getting on and then come back with your diary etc so that we can look at a way ahead.

    As regards providing information to a creditor, basically the answer is don't. Only a court can order you to disclose information like income and expenditure, financial staments etc to a creditor, medical histories and the like. This is a nasty unscrupulous business for the creditor and they will exploit every weakness you expose to them. This is not a magic wand to solve your problems neither is it always an easy road, however you will have the help and support of all of the people here on AAD most if not all have been where you are now or are still going through the mill with it all.

    Before you do anything, have a look around and shout up when you need anything but we will need some basic information from you. When the time comes to investigate documents we have a totally secure section you can upload to which only Niddy as site adminsitrator can see and you can only see your own stuff. Even the moderators cannot see what is in there only their own documents.

    The only other thing I can say at this stage, is you are quite correct and do not discuss anything of this on the telephone. All in writing only now, if they call then make them identify themselves, do not go through security, tell them writing only and put the phone down. Keep a log of all calls that come in on these matters but do not discuss anything with them. Keep all correspondence including the envelopes marked up with the date it actually arrived through your door.

    It sounds a lot to do but it isn't really and becomes habit in the end. These things sound trivial but are not in the future if matters worsen.

      Have a good read of the threads that Garlok suggests, essentially there is some information that we need to advise you of the best way to go.

      How old are your debts and are these two your only debts?
      Where are you with these debts, are you still paying and have you been defaulted?

      Don't do anything else until we can get a grip of your situation just now, and try not to worry, there is always an answer and we will always try really hard to find it for you.

        I have read the threads, I don't think these debts are old enough to take UE route.
        I don't ever recall signing anything, all I have are T & C's.

        Briefly my story is - I have not been employed full time since Sep 09, have done various temp/freelance roles while looking for part time work to supplement small pension. I've struggled to pay 3 cards robbing Peter to pay Paul & with help/support of family. I know I should have done something earlier but kept hoping something would come up, stupidly paid some bills on cards - anyway can't turn clock back.
        I have a B/card taken out Nov 07, they put the limit up & I was daft enough to pay bills on it it now at just under limit of £900

        Cap 1 taken in April 09
        Citi in Jun 08 - taken over by Opus in 2010

        I don't have cards for Cap 1 or Citi (destroyed them)

        In total I owe around 3.5K

          If you decide to go UE, then stay here - you could not be in a better place.

          If you decide on a DMP, send Niddy a pm as I believe he has a contact on the site who will negotiate these free of charge just as CCCS or Payplan etc... do.

            You are correct your debts probably are too "young" to look at UE seriously. The first thing you need to do is NOT SPEND on the cards at all. Learning to live on your available income is the way forward whatever you do with the debts. I would then do a income and expenditure, all your outgoings one side and all your income on the other. seperate column for unsecured debts. The unsecured debts colum is the last one you worry about. So check if you have enough money coming in to cover your living costs and priority debts, things like rent/mortgage, council tax, electric/gas etc. If you are still in the black at this point, look at things like insurance/car expenses/precriptions/hairdressing/clothes. If you are still in the black at this point, the best thing may well be to do a self managed DMP paying a pro-rata amount to each creditor. BUT only if there is money left at this point.
            If you do that and come back with the figures, we'll see where we are. Try not to worry too much its a manageable amount and number and we would help you set it up and do the initial correspondance. We've got 22 debts and we used to have a DMP, so it can be done quite easily!

              Hi

              With regards to I & E I currently have income of £144 & outgoings from my bank of £158.50 this is C Tax, house insurance & bank a/c charge. Everything else is covered by my Husband therefore filling in the standard I & E is not relevant to my situ. The card payments are about £100 per month. How do I get figs together to present - I don't see why my Husbands figures should be taken into account these are unsecured debts in my name - he doesn't have spare cash to continue helping. Is there a way to deal with this? Any suggestions will be appreciated.

                  Just thought I would post an update

                  Contacted the In-House Debt Advisor & they were really helpful, took time to listen & go through everything in detail. I found it really useful to talk things through, sometimes when you are in a stressful situation you don't always see things as you might if your not under pressure.
