Why is it that a cheque should be sent third party?

    Is it so they can't forge a signature later?
    So you have a 'witness' that they wrote the cheque to them?

    Or is there more?

    You can send your own in, as for £1 it would not be checked (by your bank) for signatory as it's under the floor limit so it'd be paid even if you typed your name in CLOCK CAPITALS in the siggy box....

    I never suggest you go to a 3rd party, I say you ought to send a PO if no cheque book. But the reason for this is
    1. Audit trail and proof they cashed it
    2. Stops them copying your signature - which yea, they will (and legally can) do because Carey allowed them to create recon using any means necessary!
    Its a joke, the law is a joke....

    Make sense?

      Think so so if I you have a cheque book dont use it anyway as they will come after you in years to come etc (using signature..)? Use a postal order as proof they have cashed it instead. But dont you sign a PO?
      How come no third party - is it in case you lose touch etc no proof..?

        Seems you have mis-read all of what I wrote!

        I explained that you can send a cheque, just don't sign it normally.... They can't come after you in years to come, after 6 years it'd be statute barred and paying for a CCA via cheque is irrelevant as it's not used towards the debt anyway!

        As for PO's - you've lost me, I know you don't sign, so what is the point exactly?

          What do you mean - what is it about 3rd party? And where did you get such info cos it wasn't from here - we never suggest using a 3rd party for anything.....

            no, I kept reading on MSE etc that people are or should be sending third party cheques to pay thier debts, DMP's, F&F's etc so just thought there may have been a reason - I didnt know that it was opposite here...idk, getting confused.....so to clarify; the advice is no cheques from nowhere - pay by PO.

            RE: PO, I thought you maybe had to sign them


            Edit - but then if you paid a F&F with a cheque your F&F letters etc would be proof they cant come after your debt again (after forging signature..) anyway then wouldnt it.

              PO is better but if you have a cheque book then feel free to send one just alter your signature so that if they then send an agreement with that dodgy siggy on it you'd know it was a recon and not the real thing (based on the fact that you used a dodgy signature)... make sense?

              No the PO clerk signs them, then when the recipient gets it they sign to confirm they are the recipient (like a giro I believe).....

              Totally, however different situation - if you admit to the debt and are not considering any unenforceability etc then you'd have nothing to hide anyway, in respect of signatures......

              Don't believe all you read on MSE, similarly, don't believe all you read on here - instead, make your own mind up who would be best giving such advice based on other posts on MSE (including mine - prior to my setting up this forum) and the diaries here.....

                  They suggest third party for a F&F so that if it is cashed the contract is supposedly with a 3rd party.

                  However, this is not strictly true and as Niddy says above, especially regarding F&F's, don't believe MOST of what you read as it will be inaccurate. They are incredibly complicated and I would say not to be done without appropriate specialist legal advice, otherwise you could part with your money and very easily end up owing the debt still.

                  Not going into detail as it would take all day, but I assure you this is sound advice.
