    Can you clarify, did you not originally respond to RBS with terms & conditions template?

    If RBS have sent a cca (or what they confirm they think is one) then you classify that as served. If however they ignore you then sell the account, you'd send the account sold in dispute letter. It depends what they have sent you, now from memory (sorry if i'm wrong) I was sure you had previously received a reply from RBS with terms and no agreement - if so then my template suggestion above is spot on (to send tryiton)

          OK Niddy,

          will send CCA query - application form received as you have advised..

          Sorry to have gone round and round but just wanted to double check and get my head around it all. What threw me was that you said to send "Account sold whilst in dispute" letter to other Triton letter rec'd for my Tesco account which was exactly the same letter rec'd from Triton to my RBS.

            one other thing ...... I will have to edit the above template where it says "you" to "Royal Bank of Scotland" as I did not request the CCA from Triton but the OC and have not written to Triton ref. this account before ....is that correct?

              How many times do I say "don't ever compare" - and the reason I say this is because if they (Triton) get two letters the same then how stoopid does that make a) This site look and b) You look?

              So we deliberately do things in opposites - bear in mind I also know who else has written to them using my templates that week so if I know 10 users sent letter X, i'm likely at some point to suggest others send letter Y before sending others to letter Z..

              Please, learn to trust me - I actually do know what i'm doing here, believe it or not mate

                Nope, no need as they are liable, so it doesn't matter who ytou sent the CCA to - both are jointly liable as the other - they don't need changing!

                  I thought I was doing so well on my learning curve too. Looks like its turned into a triangle now .

                    I'm not usually a pernickerty kinda person but on this occasion I have been .

NID says send "account sold whilst in dispute of CCA request" letter.

                        21/01/11 - Above letter sent.

                        24/01/11 - Calls received daily from Triton - Ignoring/Not answering.

                        Had another letter today from Triton saying:

                        “disappointed that you’ve failed to make payment or repayment proposals…..no alternative but to consider further action…may be appropriate to request a debt recovery agent call on you to discuss repayment…would prefer not to take this action so call to discuss outstanding balance”


                        Is there anything I need to send back to Triton or do I just ignore for now?

                          I have an update to the above account:

                          UPDATE: 08/02/11


                          Received another letter from Clarity today ref my EGG account. It says:


                          STOP FURTHER ACTION NOW
                          “we wrote recently but note we have not reached an agreement with you…your acc is in default and full balance is payable immediately….if the agreement remains legally enforceable we will consider recommending our client/solicitors commence legal action.. if you ignore this letter further recovery action will take place…to prevent this pay balance/arrange repayment by instalments via web site; call; e-mail; send cheque”



                          This is probably a standard letter – but if you need to see it Niddy let me know and I can e-mail you a copy.

                          It’s quite interesting they say in their letter “if the agreement remains legally enforceable we will consider recommending our client/solicitors commence legal action”.

                          Is there anything I need to send back to Clarity or just ignore and see what their next move is?


                          The "Threat o Gram before action" letter I sent to Clarity on 27/1/11 is showing on Track and Trace as only being delivered today, so do I wait for their response to that letter?
