NID says send "account sold whilst in dispute of CCA request" letter.

      21/01/11 - Above letter sent.

      24/01/11 - Calls received daily from Triton - Ignoring/Not answering.
      04/02/11 - Letter rec'd from
      Triton: “disappointed that you’ve failed to make payment or repayment proposals…..no alternative but to consider further action…may be appropriate to request a debt recovery agent call on you to discuss repayment…would prefer not to take this action so call to discuss outstanding balance”

      10/02/11 - NID says send "harassment/doorstep visit" template. Letter sent.

      I have another update to the above account:

      UPDATE: 12/02/11

      Had another letter today from Triton saying:

      “NOTICE OF DEBT RECOVERY ACTION”

      “..we remain disappointed you have failed to settle debt/make repayment proposals….we have now recommended to Tesco that solicitors be instructed to commence court proceedings which you would be liable for costs……may involve CCJ which would be a public record…..should debt remain unpaid we may ask court to enforce debt…..enforcement options open to us are:

      • County Court Bailiff to visit your home to take possessions;
      • A Charging Order;
      • Your employer deducting monies from salary;
      • You attend court to give detailed examination of personal financial affairs.


      …we would far rather come to a satisfactory arrangement…contact us to discuss the moment you receive this letter.”



      Is there anything I need to send back to Triton in response to this?

                06/01/11 - Letter from Collect Direct "payment arrangement revoked - must contact them within 5 days to arrange alternative or may advise client to take legal action". Ignored last letter.
                14/01/11 - Letter from Collect Direct: "URGENT NOTICE. Must make a payment or contact them to discuss payment arrangement or will advise client to issue court proceedings.
                17/01/11 - "Threat O Gram before court action" letter sent to Collect Direct.
                19/01/11 - NID's says shouldn't have sent last letter - too late now as letter received - see what happens next.
                19/01/11 - Nid says send CCA reminder to Citi.

                20/01/11 - CCA reminder sent to Citi.

                Letter from H L Legal "we act on behalf of Collect Direct....pay in next 7 days or will recommend legal action.... a claim for associated cost and interest will be made......hope course of action can be avoided by contacting client to make arrangements to pay" - NID says ignore.

                Letter received today from Opus (who are dealing with Citi acc):

                “we are sorry you have reason to complain….we should be able to send you a full response within 8 weeks”

                Not sure which letter they are referring to (maybe
                "Threat O Gram before court action" letter sent on 17/01/11 to Collect Direct or CCA reminder sent to Citi on 20/01/11?).

                I will file and see what happens next.

                      I still have not received my CCA for this acc. from my request back in October last year. The last I heard from them was a letter acknowledging my CCA request on 22/10/10.



                      What do I need to send back to them Sir Niddy?

                      ***Further update: 19/02/11 - I have now received CCA for this acc. see my post no. 166***

                          Calls received daily from Clarity - Ignoring/Not answering.
                          08/02/11 - Letter rec'd from Clarity:“we wrote recently but note we have not reached an agreement with you…your acc is in default and full balance is payable immediately….if the agreement remains legally enforceable we will consider recommending our client/solicitors commence legal action.. if you ignore this letter further recovery action will take place…to prevent this pay balance/arrange repayment by instalments via web site; call; e-mail; send cheque”

                          10/02/11 - NID says ignore last as letter crossed with my letter of 27/01/11

                          I assume it’s in response to my letter sent to them on 27/01/11 “threat o gram before legal action”.

                            Had a few letters this morning from RBS; Tesco and Barclaycard Visa - I will get my head around them and post back on here with the details soon.

                              Letter from RBS received in response to my “Application form received” letter I sent to Triton on 3/2/11.

                              They are basically saying that the:

                              "CCA is a true copy....do not consider the account to be in dispute....will be pursuing for full payment....see no reason to enter into further correspondence with the alleged CCA breaches."

                              Do I need to send anything? or just ignore and see what their next move is?

                                Update to above acc: 19/02/11

                                Letter from Tesco received in response to my “Threat o gram – to commence litigation” letter of 14/02/11 sent to Triton. It says:

                                “ we do not consider acc to be in dispute….have fully complied with CCA request….indebtedness remains due and payable and will pursue for full repayment….this is our final response…if dissatisfied with this final response you may refer concern to FOS…..”


                                Do I need to respond with anything on this one?
