      No! Thanks for the nudge. The only thing that I have heard off anyone for months is from Barclaycard telling me that they are still looking for the agreement that I have asked to see. They have been looking for nearly two years now!!

          I do pop in from time to time but don't always post anything. I don't feel right just posting for the sake of it. I also don't feel qualified to advise people on what they should do in their particular situation. I would hate to give them advice that wasn't the best possible, that had a better alternative. If I see someone has a situation to mine then I will chip in then. I know that people need support to cope with their journey, I know I did and I will be eternally grateful for that. I've said it before and I'll say it again, I'm not sure what would have happened had I not found this site. I was in a really dark place and it was horrible. If anyone is starting out on their UE journey then have a look at my diary. It doesn't take Einstein to work out what my total debt is but a few battles along the way, court threats, one CCJ (didn't take action in time - head in the sand!) we are hurtling towards SB already around 2/3 of the way there. If I can do it, anyone can.

            None of us are qualified to advise people billytommo, we just offer help based on our own experiences and what we have learned along the way. Sometimes, especially for new members who are often in a very dark place, just a few words saying that you know how they feel or not to worry can help them to realise that they're not alone. That in itself is a big boost for a lot of people.

              Well, I shouldn't have opened my big mouth! Just when I hadn't heard from anyone in what seemed like ages, up pop Shoosmiths with what they say is a re-created copy of my original agreement. This is the Nat West one that we were at stalemate over a couple of years ago because NW were demanding a signature. They say that it is now fully legible. The application form is missing, however. Do I send this in to get looked at or is there something that I can send them to put them back in their box?

                    What was the last paragraph of Shoosmiths' letter?

                    Did it say something like "so we have now fulfilled our obligations under s.78 and if you don't make arrangements to pay within the next 14 days we will issue legal proceedings against you without further notice" or words to that effect.

                    Just checking it's not a Letter Before Action because Shoosmiths have a reputation for being trigger happy with claims.

                    We have a suitable template letter response for you to send if it is a LBA so no need to worry

                    Can you post a link to this debt in your diary or a C & P of the post so we can do a risk assessment before suggesting your next move.

                      Sorry for the delay but the letter doesn't appear to be a LBA as it just states that the agreement that they have just resent to me is now fully legible They then go on to say the they have included an I&E form for me to fill in with a view to me submitting repayment proposals. They finish by saying they will seek their client's instructions in relation to issuing proceedings. It doesn't mention S. 78 or anything like that. I am working away at the minute so will send to Niddy for his opinion at the weekend.

                            I haven't actually but I thought that the idea was that he was alerted to anything that appeared in the new section and then he could decide who to allocate it to. I'll send him a short message to ask him

                              It's a weekend so maybe it's a bit too soon to nag Niddy for an instant answer

                                No legal threat at the minute but I suppose I am always cautious with this lot as it was them who got a CO on my house That was early days I know and at the very start of my UE journey. I hope that he doesn't see it as nagging because that certainly wasn't the intention
