  • Re: BillyTommo's UE Diary

My technically NW account due to 4 sets of terms being sent. I sent the 'sold in dispute' template to Wescot. I've had a couple of letters regarding this telling me that they are investigating, they've written to their client, They have now written to me again saying that they now consider the matter has been resolved because their client says so "Oh, okay, I'll get my chequebook out then!"

NW have been busy, just received another letter off them regarding the account that they wouldn't send the CCA for without a signature. Saw why when I got it; totally illegible. Sent the appropriate template and now they have written to tell me they are passing my account to Direct Legal. Think I'll wait this one out too
My NW account deemed totally illegible by Niddy, therefore Now Shoosmiths have written stating that I haven't responded to their letter of last month. I didn't receive one from them, I think they're just trying it on. They have had the CCA Query - Illegible Document Received - allaboutDEBT UK in January. I think a one-liner is in order to tell them to read it again!!

You can adapt the length that you want them to freeze interest or hold off.

Youme back if you need further assistance
This was re-asking two creditors who I am continuing to pay to consider freezing or at least reducing interest on the account. I have received a response off one of them stating that they need an I&E form filling in before they will consider. My question is is this the usual course of action? Does anyone have any experience of gaining a favourable response from the CC companies?

They do this so to see exactly how much they can squeeze out of you. I take it this is something you haven't been defaulted on mate? Not sure how much slack it will give you (if any) mate although others who have been dealing with these may be along soon to give you some more accurate advice.
                  Good luck!

I am now saving the money each month that was making little difference to the balance and not a bit of difference to my credit file as a result of finding AAD.

Yea they want one usually to assess things, however ONLY a court can actually demand one. If you refuse they may refuse to help, so it's up to you whether you actually complete it or not.

That's exactly what I was thinking- isn't it in my own interest to provide this information? I know I could have stopped paying these two and they are most likely but I didn't for one reason or another. If they don't agree to a reduction in the interest rate then I may have to stop these as well because the min payment is only the interest

I would be asking for suspension of all interest...... but yea fill one in, just stick to within the trigger figures of CFS - if anything PM Undercover Elsa your I&E and she can check it over (she has my full support and trust, you're perfectly safe doing this) - thing is you might only pay £100 per month rent but if CFS allows £500pm then obviously, you'd boost it to waste more income sort of style...

I would, just say I asked you to - she'll then run it against CFS Trigger Figures

mate, if you dont use these credit facilities, and you want them to stop interest, then stop paying, wait for a default notice, then a termination letter, and then offer a repayment you can afford.

Otheriwse they can continue to add interest if they wish.

Even if they are enforceable its unlikely any litigation will happen before you get a chance to offer a repayment. Worst case they would prob asign to a DCA who would accept a low repayment plan.

Most can freeze interest and agree a reduced payment if you send them an I & E, but its a strong possibility they will default you during this period anyway, as part of their normal collection procedures, so the choice is yours.

SXGuy makes a valid point. Truth is creditors won't listen until you stop paying. Madness really, but that's how it works.
