Hello, it has been very, very quiet at the moment, not complaining though.

McKenzie Hall have been back in touch, did send a letter to me a couple of weeks ago telling me to phone them which I duly ignored and filed, letter in today telling me that I have until 12 Noon on 15 September to pay or they will be taking the matter further, court etc mentioned as per usual.

Send out 'Threat of Litigation' letter? Cheers and hope everyone is well

Yea and in that case I'd already beaten them, you just finished the job off properly.

    I'm not worried about Cabot

every case is different and there is absolutely no point in worrying about something that might not happen, if we worried about every single one going to court, we'd be bonkers!

    sorry,

But it is a reality, i deal with litigation daily vs these peeps and they do not look at the real case til the claim is issued it seems,

They have discontinued a number of cases that should never have even been written on a court claim form, but did,

Im just trying to make you aware of what could happen with them.

They have contacted Clydesdale and hope to be back in contact in the next 12 days. But they would still request we contact them to discuss repayment options

So will wait for the next letter from them. I do like the last para on the letter tho.

'I note your comments regarding a visit to your home. We shall attempt to avoid a doorstep collector being instructed, however if you do not co-operate in resolving your outstanding account, we reserve the right to escalate your account as we deem necessary and this may result in the instruction of a doorstep agent. I trust I have set out our position clearly.'
Cabot do litigate real quickly, so you should be prepared for a court claim to drop through your letter box .

I would suggest reading up on the rules surrounding litigation, your rights to documents etc and the rules on extending the time for your defence

its better to be prepared than to have it fall in your lap
