    Really? Lots of errors, as such this is a defective DN....

    1. They can only demand the arrears, the DN should show the arrears to remedy then a separate entry with the total balance as at default date
    2. The dates - 25th June + 2 days to post + 14 days service to remedy period = 11th July. Not 9th = defective default notice.
    3. No OFT factsheet

    I wouldn't worry about this too much
    I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website. I am extremely busy so if you do contact me or need a reply to a forum post then use the email or PM features offered because I do miss things and get tied up for days at a time!

    If you spot any spammers, AE's, abusive or libellous posts or anything else that just doesn't feel right then please report them to me as soon as you spot them at: webmaster@all-about-debt.co.uk

      Thanks Niddy I wasn't too concerned about NDR Scabhunter more or less said the same as you,I'm just going to send moor croft the one liner as suggested,also I emailed you a letter I received today I know it's not an agreement but thought you could take a look at it and see what you think thank you x

        if you do it today and you like it you can always do it again tomorrow

          Thanks Nanna, I appreciate your support ,it's good to know that NDR are easy to see off , oops I hope I didn't speak too soon!!!! The kind of luck I've got they'll probably send their heavy squad to my door!

            Dont think so i sent them 1 letter never heard from them again anyhow they have no right to be at your door and if they did come (which is doubtful) close door or if you have to threaten to call the police as they are tresspassing.xxxxxxxxxxxxx
            You could always get on your hands and knees in the hall and bark loudly
            if you do it today and you like it you can always do it again tomorrow

              I had an obnotious person on the phone once- I pretended the lads were with me - stating hey lads fancy a trip to Scotland to sort a company out? the phone answer was "sir, we will not be contacting you again". = silence.

                Thanks Nanna and Gangshield, you both made me laugh Nanna I can just imagine my Hubbys face with me on the floor barking like a dog!!!! As for " getting the lads" it takes me to answer the phone these days but thanks for your wonderful funny tips ,loving the humour on this site

                  Hi,
                  I've received a letter from bank of Scotland stating " as we haven't been able to agree a suitable repayment plan we've transferred your account to apex credit management ltd.,contact them as soon as possible". In the same envelope there was a letter from apex stating they have received instructions from our client to act as intermediary between you and bank of scotland etc.
                  I had sent bank of Scotland the threat to commence litigation letter .
                  Now what do I do? Any suggestions will be much appreciated xx

                          July 3rd Sent threat to commence litigation letter
                          July 20th Received letter from bank of Scotland stating my account has been passed on to Apex Credit Management ,in same envelope Apex letter asking me to contact them to make arrangements to pay as soon as possible[/QUOTE





                          I have received letter from Apex stating they believe I'm avoiding paying debt owed ,and that they utilize external data to profile accounts and they know I have the ability to pay this account. They also say that my account will be passed to their internal litigation team in order to consider the best course of action for recovery of debt. This may include legal action to obtain a sheriff court decree which they may then seek to enforce by way of an inhibition or earnings arrestment application.

                          Now I know this debt is enforceable and I'm blagging it should I send them account sold whilst in dispute letter or has anyone got any other suggestions? Thank you

                              Thanks MrsD , I wasn't too sure what to send them they've been constantly phoning my home number and I was on the verge of sending them a telephone harassment letter ,as they kept telling my OH that I was ignoring them, so by sending the sold in dispute letter it will let them know that I'm not ignoring them (if that makes sense !!!)

                                That phone number certainly worked for me with Arden, they now just write about once every two weeks.
